1 . This A c t m a y be cited as t h e " W i d t h of Streets and Lanes
| Ac t , | 1902 . " |
2 . The A c t forty-five Victor ia n u m b e r twen ty -e igh t is hereby
| repealed. | 3 , |
3. E v e r y s t reet laid out or defined since t h e t w e n t i e t h day of December , one thousand e ight hund red and eighty-one, or hereafter laid out or defined, shal l be s ixty-six feet wide a t l e a s t ; and every lane
laid out or defined since t h e said t w e n t i e t h day of December , one
thousand e igh t h u n d r e d a n d e ighty-one, or hereafter laid o u t or
defined, shall be t w e n t y feet wide a t least . 4 . A n y land wh ich has been since t h e twen t i e th day of December ,
one thousand e igh t h u n d r e d and e ighty-one, or is hereafter sold, t ransferred, leased, or bui l t upon , in violat ion of t he provisions of section one of t he Ac t he reby repealed, or of section th ree of th i s Act , ' shall , w h e n necessary to m a k e t h e wid th of any such street or lane equa l to t he r equ i r emen t s of th i s Act , be deemed to t h a t e x t e n t to form pa r t of such s treet or l ane :
Provided t h a t w h e n i t is necessary to define t he wid th of any
street or lane unde r th is Ac t , t h e necessary wid th m a y be de te rmined by measur ing from t h e cent re of such s treet or lane .
5 . (1) E x c e p t in t h e case of a l lo tmen t s h a v i n g water f rontage,
no dwel l ing-house shall be bu i l t f ront ing a n y lane wi th in the operat ion
of th i s A c t unless such house a n d its appur t enances are twen ty - th ree feet a t t he least f rom such lane .
(2) A n y premises bu i l t as a dwel l ing-house or occupied or
inhab i t ed as such, a l t h o u g h such premises or any pa r t thereof a re occupied or used for o ther purposes a t t h e same t ime shall , if bu i l t less t h a n twen ty - th r ee feet f rom such lane, be deemed to be a n encroachment , and if w i th in t he c i ty of Sydney m a y be deal t w i t h by
the proper au tho r i t y as an enc roachment unde r t h e provisions of t h e
Sydney Corporat ion Ac t , 1902, a n d if w i th in a n y munic ipa l i ty shall
be deemed to be a nu isance wi th in t h e m e a n i n g of the two h u n d r e d
and for ty-s ix th section of t h e Munic ipa l i t ies Act , 1897. 6 . N o t h i n g here in contained shal l be deemed to affect any street
or lane or a n y f rontage to any s t reet or lane or any cont inuat ion of
a n y s t reet or lane defined or bu i l t upon , or any bui lding commenced or bu i ld ing a g r e e m e n t entered in to before t he twen t i e th day of December ,
one t housand e igh t h u n d r e d a n d e ighty-one, or a n y law or regula t ion
no t r e p u g n a n t to t h e provisions of th i s A c t : Provided tha t no such con t inua t ion as hereinbefore ment ioned
shall ex tend beyond the n e x t in te rsec t ing street .
