CaseChat Overview and Summary
The primary legal issue before the SAT was whether the proposed agreement was consistent with the relevant legislation and policies governing the transfer of functions from a local government to a community organisation. The SAT had to consider whether the agreement would ensure that the community's needs were met and whether the terms of the agreement were fair and reasonable. Additionally, the SAT had to assess whether the agreement complied with any relevant statutory requirements and whether it would result in any significant financial or administrative burden on the community.
The SAT found that the proposed agreement was appropriate and in the best interests of the community. The tribunal noted that the agreement would ensure continuity of essential services and that the terms of the agreement were fair and reasonable. The SAT also found that the agreement complied with relevant legislation and policies and would not result in any significant financial or administrative burden on the community. The tribunal was satisfied that the proposed agreement was the best way to ensure that the community's needs were met and that the Centre was well-positioned to take on the functions previously provided by the Shire.
The SAT approved the proposed agreement, subject to certain conditions. These conditions included the requirement that the Centre provide regular reports to the Shire and the community, and that the Shire provide support and assistance to the Centre as needed. The SAT also noted that the agreement could be reviewed and amended if necessary in the future. The approval of the agreement marked an important step forward for the Wickepin Community Resource Centre Inc., ensuring that essential services would continue to be provided to the community.
