The court considered the principles of construction of wills and the ordinary grammatical meaning of the words used. It concluded that the refund of the interest-free loan did not constitute the proceeds of "real estate owned by the deceased at the date of his death." The court found that the sub-lease and the interest-free loan were separate transactions and should not be amalgamated. The refund of the interest-free loan was part of the residue of the estate and should be distributed equally between the son and daughter. The court directed that the applicant distribute the sum of $355,700.57, referred to in the affidavit of Scott Graham Whitla sworn on 8 April 2014, pursuant to clause 3.5 of the will of Allan James Launchbury dated 9 April 2008. This sum formed part of the residuary estate.
