No. 38 of 1964.

AN ACT to revive and continue the operation of the Wheat Marketing Act, 1947-1956, and to validate certain acts, matters and things and for other purposes.

[Assented to 12th November, 1964.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. This Act may be cited as the Wheat

2. The Wheat Marketing Act, 1947-1956 which hundred and sixty-one

as amended,

revived and

expired on the thirty-first day of October, nineteen

continued.

(a)

shall be and is hereby revived;

(b)

shall be deemed to have been in operation from the thirty-first day of October, nineteen hundred and sixty-one; and

(c)

shall continue in operation until the thirty-first day of Oct o b e r, nineteen hundred and sixty-nine.

Validation.

3. In order to resolve any doubts that, but for the enactment of this section, might arise, all acts, matters and things done, suffered or permitted after the expiry of the Wheat Marketing Act, 1947-1956, and before the date of the coming into operation of this Act which, if the first mentioned Act had not expired but had continued in operation until that date, would have been lawfully and properly done, suffered or permitted under the first mentioned Act, shall be deemed always to have been lawfully and properly done, suffered or permitted under the first mentioned Act, and are hereby approved.

4. A person is not liable to prosecution or

liability for

offences.

punishment for any offence under the Wheat Marketing Act, 1947-1956, in respect of any act or omission that occurred after the expiry of that Act and prior to the date of the coming into operation of this Act.
