An
Act to amend the Wheat Industry
Stabilization Act 1946.
[Assented to 14th December, 1946.]
BE it enacted by the King’s Most
Excellent Majesty, the Senate, and the House of Representatives of the
Commonwealth of Australia, as follows:—
Short
title and citation.
1.—(1.) This Act may be cited as the Wheat Industry Stabilization Act (No. 2) 1946.
(2.) The Wheat Industry Stabilization Act 1946*
is in this Act referred to as the Principal Act.
(3.) The
Principal Act, as amended by this Act, may be cited as the Wheat Industry Stabilization Acts 1946.
Commencement.
2.This Act shall come into operation on the day on which
it receives the Royal Assent.
Power of Board.
3.Section ten of the Principal Act is amended by
omitting from sub-section (2.) the figures “1945-46” and inserting in their
stead the figures “1946-47”.
Continuance of National Security (Wheat
Acquisition) Regulations.
4. Section eleven of the Principal Act is amended byomitting the figures “1945-46” and
inserting in their stead the figures “1946-47”.
Saving of acts of Australian Wheat Board.
5. Section twelve of the Principal Act is amended by omitting the word
“Act” (first occurring) and inserting in its stead the word “section”.
Employees under National Security (Wheat
Acquisition Regulations to be employees of Board.
6. Section thirteen of the Principal Act is amended by omitting the
word “Act” (first occurring) and inserting in its stead the word “section”.
Pending
applications.
7.Section fourteen of the Principal Act is amended by
omitting the word “Act” (first occurring) and inserting in its stead the word “section”.
Wheat Prices Stabilization Fund.
8.Section thirty-one of the Principal Act is amended by
omitting from sub-section (l.)all the words after the word “equivalent”
and inserting in their stead the words “to the amounts from time to time
collected under the Wheat Export Charge
Acts 1946 and the Wheat Tax Act 1946,
less any amounts necessary for the purposes of making adjustments in accordance
with those Acts”.
Offences.
9.Section thirty-four of the Principal Act is amended by
omitting sub-section (1.) and inserting in its stead the following
sub-section:—
“(1.)
Any person who contravenes or fails to comply with—
(a)any provision of this
Act for which no other penalty is provided; or
(b)any provision of any
Regulations continued in force by this Act or of any such Regulations as
amended by any regulation made under this Act,
shall be
guilty of an offence.
Penalty:
A fine of One hundred pounds or imprisonment for six months.”.
Regulations.
10.Section thirty-five of the Principal Act is amended by
inserting after paragraph (b) the following paragraph:—
“(ba) the repeal or amendment of all or
any of the provisions of the National Security (Wheat Acquisition) Regulations,
but so that any such amendment shall be in respect of a matter dealt with by
those Regulations;”.
