338 Qumuqlan^ ANNO VICESIMO TERTIO ELIZABETHAE SECUNDAE REGINAE No. 34 of 1974 An Act to amend the Wheat Industry Stabilization Act1968 -1969 and the Wheat DeliveryQuotasAct1970-1972, each in certain particulars [ASSENTED TO 2ND MAY, 1974] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same , as follows:- PART I-PRELIMINARY 1. Short title . This Act may be cited as the Wheat Industry Stabilization Act and Another Act Amendment Act 1974. 2. Commencement . Subject to section 6, this Act shall be deemed to have come into operation on the date of the coming into operation of the Wheat Industry Stabilization Act1973 of the Commonwealth.
Wheat Industry, Etc., Act and Another Act Amdt Act 1974, No. 34 339 3. Parts of Act. This Act is divided into Parts as follows:- PART I-PRELIMINARY; PART II-AMENDMENTS OF WHEAT INDUSTRY STABILIZATION ACT 1968-1969; PART III-AMENDMENTS OF WHEAT DELIVERY QUOTAS ACT 1970-1972. PART II-AMENDMENTS OF WHEAT INDUSTRY STABILIZATION ACT 1968-1969 4. Citation . (1) The Wheat Industry Stabilization Act 1968-1969 is in this Part referred to as the Principal Act. (2) The Principal Act as amended by this Part may be cited as the Wheat Industry Stabilization Act1968-1974. 5. Amendment of s. 6. Application of Act. Section 6 of the Principal Act is amended- (a) by omitting from subsection (1) the word " six " and substituting the word " seven "; (b) by omitting from subsection (2) the word " four " and substituting the word " five ". 6. Amendment of s. 21 . Home consumption price of wheat. (1) Section 21 of the Principal Act is amended by omitting from paragraph (b) of subsection (8) the words " the next succeeding section " and substituting the words " section 22 ". (2) This section shall be deemed to have come into operation on 1st December, 1969. 7. New s. 21AA. After section 21 of the Principal Act the following section is inserted:- " 21AA. Home consumption price of wheat for 1973-1974. (1) The price at which, during the year commencing on the first day of December, one thousand nine hundred and seventy-three, the Board shall sell wheat for use or consumption in Australia is the appropriate price ascertained in accordance with this section. (2) Subject to this section, the price per tonne in respect of a wholesale sale of bulk wheat of fair average quality free on rails at a port of export is the sum of the price that is the calculated price for the purposes of section 27AA of the Commonwealth Act and Nine dollars and nineteen cents. (3) For the purpose of reimbursing the Board for costs of shipment of wheat to the State of Tasmania, the price applicable under subsection (2) shall be increased by an amount of Thirty- seven cents per tonne, or, if the Commonwealth Minister has
340 Wheat Industr}, Etc., Act and Another Act Amdt Act 1974, No. 34 made a determination or determinations under subsection (4), by the amount applicable in accordance with the latest such determination. (4) If the Board, at any time, reports to the Commonwealth Minister that the amounts being received by the Board by reason of the operation of subsection (3), together with amounts being received under corresponding provisions of the Commonwealth Act and of the laws of the other States, are greater or less than the amounts required to meet the costs of shipment of wheat by the Board to the State of Tasmania, the Minister may determine that the amount per tonne to be added to the price in accordance with subsection (3) shall be reduced or increased to such an extent as he considers necessary. (5) The price in respect of a sale other than a sale specified in subsection (2) is a price per tonne ascertained by adding to or deducting from the price per tonne applicable to sales so specified an amount that makes a proper allowance for the quality of the wheat, the conditions of sale and the place of delivery.". 8. Amendment of s. 21A. Price of wheat for use in Australia otherwise than for human consumption . Section 21A of the Principal Act is amended- (a) by omitting from subsection (1) the expression " section 21" and substituting the expression " sections 21 and 21AA "; (b) by omitting from subsection (1) the words " that section " and substituting the words " either of those sections "; and (c) by inserting in subsection (5), after the expression " section 21 ", the expression " or subsection (3) of section 21 AA". 9. Amendment of s. 22 . Special account for freight to the State of Tasmania . Section 22 of the Principal Act is amended- (a) by inserting in subsection (1), after the expression " section 21 ", the expression " or subsections (3) and (4) of section 21AA "; (b) by omitting from subsection (4), the word " seventy-three " and substituting the word " seventy-four ". 10. Minor amendments . The Principal Act is amended as set out. in the Schedule. PART 111-AMENDMENTS OF WHEAT DELIVERY QUOTAS ACT 1970-1972 11. Citation . (1) The Wheat Delivery Quotas Act 1970-1972 is in this Part referred to as the Principal Act. (2) The Principal Act as amended by this Part may be cited as the Wheat Delivery Quotas Act1970-1974.

Section 5 of the Principal Act is amended by omitting from subsection (1) the word " three " and substituting the word " four ". 13. Amendment of s. 62. Modification of operation of s. 15 of State Act. Section 62 of the Principal Act is amended by inserting after subsection (4) the following subsection:- (4A) In exercising its powers under subsection (4) of section 15 of the Wheat Industry Stabilization Act1968-1974 in respect of wheat of the quota season that commenced on the first day of October, 1973, the Australian Board may have regard to the possibility that the Australian wheat quota originally determined for that season for the purposes of this Act and the corresponding laws of the other States providing for the fixing of wheat quotas may be increased by a quantity not exceeding 544,311 tonnes.". SCHEDULE MINOR AMENDMENTS [Section 10] The Principal Act is amended as set out in the following table:- Provision Section 12 (6) Section 14 (1) Section 15 (2) (b) Section 15 (2) (c) Section 15 (7) Section 21 (2) Amendment (a) Omit the words "number of bushels" and substitute the word " quantity ". (b) Omit the words "amount per bushel" and substitute the words " amount per tonne ". (c) Omit the words " Five dollars per bushel and substitute the words " Twenty dollars per 100 kilograms ". (a) Omit the words "number of bushels" and substitute the word " quantity ". (b) Omit the words "amount per bushel" and substitute the words " amount per tonne ". (c) Omit the words " Five dollars per bushel and substitute the words " Twenty dollars per 100 kilograms ". Omit the words "Two and one-half cents per bushel " and substitute the words " Ninety-two cents per tonne ". Omit the word " bushels " and substitute the word " tonnes ". Omit the word " bushel " and substitute the word " tonne ". (a) Omit the word " bushel " and substitute the word " tonne " . (b) Omit the words " One dollar seventy cents " and substitute the words " Sixty-two dollars forty-six cents ".
