P art I.— P reliminary . 1. This Act may be cited as The Wheat Industry short title. Stabilisation Act and Another Act Amendment Act of 1957.” 2. This Act is divided into Parts as follows :— Parts of Act- P art I. —P reliminary ; P art II. —A mendments oe *“ T he W heat I ndustry S tabilisation A ct of 1954 ”; P art III. —A mendments of f “ T he W heat P ool A cts , 1920 to 1930.” PART II.— P art II.— A mendments of *“ T he W heat I ndustry S tabilisation A ct of 1954.” S tabilisation 3. (1.) This Part II. of this Act shall be read as ACTOFl954- one with *“ The Wheat Industry Stabilisation Act o/tfoiT1’"3** 1954.” ' (2.) *“ The Wheat Industry Stabilisation Act of 1954,” £j°^eotivo and this Part II. of this Act may be collectively cited as 1 e‘ The Wheat Industry Stabilisation Acts, 1954 to 1957.” * 3 Eliz. 2 No. 43. f 11 G. 5 No. 4 and amending Acts.

II, No. 26, Wheat Industry Amendment Stabilisation Act of 1954” is amended— of s. 12 of 3 Eliz. IT. (a) By inserting, after subsection two thereof, the No. 43. following subsection— (2 a .) In respect of wheat of the season commenced on the first day of October, one thousand nine hundred and fifty-seven, required by The Wheat Pool Acts, 1920 to 1957,” to be delivered to the State Board, and so delivered, the Board shall increase the payment applicable under subsection two of this section by so much, not exceeding one shilling per bushel, as the Minister by notification to the Board shall determine.” ; (b) By inserting, after subsection six thereof, the following subsection:— (6 a .) In ascertaining the net proceeds of the disposal of any wheat no account shall be taken of moneys received by the Board by reason of the operation of subsection (5 a .) of section eighteen of this Act.” ; and (c) By adding to that section the following subsection :— (9.) The Board shall not be required to provide or arrange the provision of the funds necessary to make the increased payment referred to in subsection (2 a .) of this section, but the Board may arrange with the State Board for the making by the State Board of advances to the Board for the purpose of providing those funds, and for the repayment of any such advances and the payment of interest thereon.” Amendment 5. Section eighteen of *“ The Wheat Industry o3fE s l . iz1. 8IoIf. Stabilisation Act of 1954” is amended— No. 43. (a) By repealing in subsection three thereof the words “ subsection four of ” ; (b) By inserting, after subsection five thereof, the following subsection :— (5 a .) (a) The Minister may, by notification published in the Gazette, determine that the price applicable under subsection two or three of this section in respect of a sale specified in subsection two of this section made during the wheat importing year and after a date to be specified in the notification shall be * 3 Eliz. 2 No. 43.

(b) The amount specified in the notification under paragraph (a) of this subsection shall be an amount which, when multiplied by the number of bushels of wheat which the Board estimates will be the subject of all sales specified in this section made during the wheat importing year and after the date referred to in paragraph (a) of this subsection, will produce an amount equal to the sum of the following amounts, as determined or estimated, and notified to the Minister, by the Board, namely :— (i.) The costs of the increase, referred to in subsection (2 a .) of section twelve of this Act, in the payment applicable under subsection two of that section for wheat of the season commenced on the first day of October, one thousand nine hundred and fifty-seven, required by *“ The Wheat Pool Acts, 1920 to 1957,” to be delivered to the State Board, and so delivered, and of the interest payable on any advance, referred to in subsection nine of section twelve of this Act, made to the Board by the State Board; (ii.) Where wheat has been or is to be imported by the Board for sale pursuant to this section in Queensland during that year and the wheat was or is wheat not specially acquired by the Board outside Australia for the purpose of importing it into Australia— an amount equal to the costs of and incidental to the transport of the wheat from the place from which it is or is to be imported to a port of import in Queensland (including the costs of and incidental to the loading of the wheat at the port of export outside Queensland and the unloading of the wheat at the port of import in Queensland); (iii.) Where wheat has been or is to be imported by the Board for sale pursuant to this section in Queensland during that year and the * 11 G. 5 No. 4 and amending Acts.

II, No. 26, SW hkat __ __________________________________________________________________________________ INDUSTRY S tabilisation A ot of 1954.** wheat was or is wheat specially acquired by the Board outside Australia for the purpose of importing it into Australia—an amount equal to the difference between the sum that would have been realised by the Board had this subsection not been enacted and had the wheat so imported or to be imported been sold by sales of the kind specified in subsection two of this section and the costs of and incidental to the purchase of the wheat and its transport from the place from which it was, or is to be, imported to a port of import in Queensland (including the costs of and incidental to the loading of the wheat at the port of export outside Queensland and the unloading of the wheat at the port of import in Queensland); (iv.) An amount equal to the costs of and incidental to transporting any wheat transported or to be transported for sale during that year from a port of import in Queensland to the places of delivery in Queensland from which the wheat is to be delivered by the Board pursuant to sales in respect of which the price is to be ascertained in accordance with subsection six of this section (including the costs of and incidental to the loading of the wheat at the port of import in Queensland and the unloading of the wheat at the places of delivery in Queensland); and (v.) An amount equal to the sum of the deductions to be made during the wheat importing year and after the date referred to in paragraph (a) of this subsection, for the purpose only of making proper allowances for the places of delivery, pursuant to subsection six of this section, less— (vi.) Any payments otherwise received or to be received by the Board in respect of any such amount. (c) If at any time during the wheat importing year the Minister is satisfied that the amounts then actually received, together with the amounts, as estimated by

A mendments of “ T he W heat I ndustry the Board, thereafter to be received, by the Board by SA tcatboilfis 1 a 9 t 5 i 4 o . n reason of the operation of this subsection (together with any payments referred to in subparagraph (vi.) of paragraph ( b ) of this subsection then actually received by the Board, and any payments so referred to, as estimated by the Board, thereafter to be received by the Board) are more or less than the sum of— (i.) That part of the amounts referred to in subparagraphs (i.), (ii.), (iii.) and (iv.) of paragraph (b) of this subsection in respect of which the Board has then actually incurred liability; (ii.) That part of the amounts so referred to, as estimated by the Board, in respect of which the Board will thereafter incur liability; (iii.) The sum of the deductions referred to in subparagraph (v.) of paragraph ( b ) of this subsection then actually made by the Board ; and (iv.) The sum of the deductions so referred to, as estimated by the Board, to be thereafter made by the Board, the Minister may, by notification published in the Gazette, determine that the price that would have been applicable under subsection two or three of this section in respect of a sale specified in subsection two of this section had this subsection not been enacted shall be the price applicable to such a sale made during the wheat importing year and after a date to be specified in the notification, or shall, in respect of such a sale made during that year and after that date, be increased by an amount specified in the notification, as the case may be. Any notification under this paragraph shall have effect according to its tenor and shall have effect notwithstanding any prior notification under this subsection. Notifications under this paragraph may be made from time to time as the Minister thinks fit. (d) The provisions of this subsection are in addition to and not in substitution for the provisions of subsections four and five of this section.” ;
8 AGRICULTURE. P art II.— A mendments of “ T he W heat I ndustry S tabilisation A ot of 1954.” Wheat Industry Stabilisation Act, Etc., Act. 6 E liz . II, No. 26, (c) By adding to subsection six thereof the following paragraph :— “ Where wheat is sold by the Board during the wheat importing year and the sale is a sale in respect of which the price is ascertained in accordance with the provisions of this subsection, the wheat shall, for the purpose of making a proper allowance for the place of delivery under the contract for the sale, be deemed to be wheat received pursuant to this Act by the Board at that place of delivery.” ; (d) By inserting in subsection seven thereof, after the definition of “ the International Wheat Agreement price ”, the following definition :— “ “ wheat importing year ”—Means the period of twelve months commencing on the first day of December, one thousand nine hundred and fifty-seven;” ; and (e) By adding to that section the following subsection:— (9.) Collective title. (2.) *“ The Wheat Pool Acts, 1920 to 1930,” and this Part III. of this Act may be collectively cited as The Wheat Pool Acts, 1920 to 1957.” Amendment of s. 5 b (1) 7. Subsection one of section 5 b of *“ The Wheat of 11 Geo. V. Pool Acts, 1920 to 1930,” is amended by inserting, after No. 4. the words “ including the making or arranging for advances under section ten hereof ” the words “ the * 11 G. 5 No. 4 and amending Acts.

[ 10 b .] The Board may arrange with the Australian Advances Wheat Board constituted by the f Wheat Industry theB°ard to Stabilization Act 1954 of the Commonwealth for the making by the Board of advances to the Australian Board.
