Wheat Industry Fund Regulations 2(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council and after being informed by the Minister of State for Primary Industries and Energy that he has considered a report by the Grains Council of Australia made after consultation with the Australian Wheat Board, make the following Regulations under the Wheat Marketing Act 1989.

1.   Commencement

1.1   These Regulations commence on 30 June 1991.

2.   Amendment

2.1   The Wheat Industry Fund Regulations are amended as set out in these Regulations.

3.   Regulation 4 (Use of Fund money)

3.1   Subregulation 4(1):

Omit the subregulation.

4.   Regulation 5 (Annual Business Plan)

4.1   Subregulation (1):

Omit “each season”, substitute “each year starting on 1 October”.

5.   Regulation 6 (Management of Fund)

5.1   Subregulation 6 (1):

Omit the subregulation, substitute:

“(1)

For the purposes of the management of the Fund, the financial year is the year starting on 1 October.”.

5.2   Subregulation 6 (3):

Omit the subregulation.

6.   Regulation 8 (Equity in Fund)

6.1   Subregulation (1):

Omit “30 June”, substitute “30 September”.

6.2   Paragraph (1) (a):

Omit “1 July”, substitute “1 October”.

6.3   Paragraph (2) (a):

Omit “1 July”, substitute “1 October”.

6.4   Paragraph (2) (c):

Omit “30 June”, substitute “30 September”.

7.   Regulation 9 (Issue of statements by Board)

7.1   Subregulation (1):

Omit “30 June”, substitute “30 September”.

7.2   Paragraph (1) (a):

Omit “1 July”, substitute “1 October”.

7.3   Paragraph (2) (b):

Omit “1 July”, substitute “1 October”.

8.   Regulation 11 (Certificates of Equity)

8.1   Paragraph (3) (c):

Omit “30 June”, substitute “30 September”.

9.   Transitional

9.1 For the purposes of the management of the Fund during the period starting on 1 July 1991 and ending on 30 September 1991, the business plan for the Wheat Industry Fund prepared by the Board to cover that period and in existence on 30 June 1991 is taken to be the business plan for the purposes of section 83 of the Act.
