An Act to make better provision for the Col­ lection of Wharfage and Tonnage Rates. [12th July, 1880 . ]

WH E R E A S imposi t ion and collection of W h a r f a g e and Tonnage Rates and to
it is expedient to a m e n d the L a w regu la t ing t h e
embody t h e same in one S ta tu te Be it therefore enacted by t h e Queen ' s
Most Exce l len t Majes ty by a n d w i t h t he advice and consent of the
Legislat ive Counci l and Legislat ive Assembly of N e w South W a l e s in
P a r l i a m e n t assembled and by the au thor i ty of t he same as follows :—

1. This A c t shal l come in to force on the first day of J u l y in t he year one thousand e igh t h u n d r e d and e ighty a n d m a y

be cited for

all

purposes as t h e " W h a r f a g e and Tonnage Rates A c t of 1 8 8 0 " I n its
cons t ruc t ion t h e expression " Pub l i c W h a r f " means t h e Circular

Q u a y and t h e Queen ' s W h a r f a t t h e Po r t of Sydney and a n y wharf w i th in t he Colony appointed to be a publ ic or legal wharf unde r any A c t i n force for t h e t ime be ing r egu la t ing t he Cus toms—the expression " P r i v a t e Sufferance W h a r f " means a n y wharf for which a sufferance has been or shal l hereafter he g ran ted in pursuance of a n y such A c t as aforesaid for t he land ing of goods subject t o t h e p a y m e n t of Customs

du t i e s—and t h e word " Whar f i nge r " means t h e owner or lessee of a

pr iva te sufferance wharf or t h e agen t of either.
2. P r o m and after t he commencemen t of th is A c t t h e Acts and por t ions of Acts specified in t he First Schedule here to shal l bo repealed b u t such repeal shall no t prejudice or affect a n y rates collected or a n y t h i n g lawfully done or commenced unde r t he au tho r i t y of t he said

Acts or a n y of t h e m .
3. U p o n t h e l and ing on any publ ic or pr iva te sufferance wharf

in N e w South Wales of any goods merchandise packages or articles e n u m e r a t e d or ment ioned in t h e Second Schedule here to i t shall be lawful to levy rates to be t e rmed " I n w a r d W h a r f a g e Ra te s " not exceeding t h e respective rates prescribed in t h e Tariff and Scales of Charges conta ined in t h e said Schedule Provided t h a t all goods

ar r iv ing from any of t h e Aus t ra las ian Colonies or N e w Zealand or a n y
of t h e Pacific I s lands landed on a n y publ ic wharf and entered a t t h e
Cus tom H o u s e for t r a n s h i p m e n t shall be e x e m p t from a n y wharfage
ra tes chargeable u n d e r th i s Act.

4. I t shall be lawful to levy wharfage ra tes in respect of a n y good merchandise packages or art icles laden whe the r in to vessels l igh ters or boats from any such publ ic or pr iva te sufferance wharf as aforesaid to be t e r m e d " Ou tward W h a r f a g e Rates " no t to exceed one- half of t h e respective rates and to be levied and computed in accordance w i t h t he scales specified in the Second Schedule here to .

5. E v e r y vessel u n d e r two h u n d r e d and forty tons registered

t onnage a n d every l igh ter r equ i r ing a be r th for loading only shal l pay for each day or por t ion of a day du r ing w h i c h she shal l occupy a be r th a t any such publ ic or p r iva te sufferance wharf a wharfage ra te of t e n shil l ings.

6. I t shall be lawful to levy a r a t e of one f a r th ing per ton per diem on all vessels fully laden d ischarg ing their inward cargoes a t any such publ ic or pr iva te sufferance wharf and a r a t e of one hal fpenny pe r ton per d iem on all o ther vessels par t ly laden dur ing the t ime which such vessels shall occupy a be r th a t a n y such wharf b u t such r a t e shal l not be leviable u n t i l after the expira t ion of t h e respect ive periods specified in t he Third Schedule here to Provided a lways t h a t in t h e case of any vessel pa r t ly laden or wh ich shal l have discharged only a por t ion of he r inward cargo a t any such wharf such vessel shal l be ent i t led to claim " free lay d a y s " according to t h e q u a n t i t y of cargo discharged which shal l be considered to be t h e propor t ion which t h e a m o u n t of such cargo bears to t he tonnage of t he vessel w h e n fully laden.

7. A n y vessel of two h u n d r e d and forty tons regis tered t o n n a g e

or upwards r equ i r ing a be r th for loading only shal l pay a r a t e not exceeding one hal fpenny pe r t o n per day from t h e date of occupying a b e r t h a t any such publ ic or p r iva te sufferance wharf and after t h e expira t ion of twenty-f ive days from such da te shall pay half t h a t ra te

for each day d u r i n g wh ich she occupies such be r th .

8. N o clearance shal l be g ran ted for any vessel l iable to t h e

p a y m e n t of tonnage rates a t any publ ic wharf w i th in t he m e a n i n g of

th i s A c t unless a receipt for the p a y m e n t of such rates s igned b y t h e p roper officer or person shall be presented to t he Collector or o ther proper officer of Cus toms .

9. I t shall be lawful for the mas te r of any vessel which shal l occupy a b e r t h a t a n y such publ ic or p r iva te sufferance wharf for t h e purpose of d i scharg ing inward cargo to deliver to t h e consignee impor ter or his agen t any goods so to be discharged w i t h o u t molesta t ion or inter­ ference b y the collector or wharf inger or b y a n y person whomsoever

a n d w i t h o u t any charge o the r t h a n the respect ive rates au thor ized b y
th i s A c t A n d for t h e purpose of g iv ing effect to t h e in t en t ion of th i s
e n a c t m e n t duly author ized shal l du r ing Custom-house hours for t h e discharge of all impor te r s and consignees the i r agents and servants be ing such vessel have free access to and from t h e ship 's side whi ls t so
d ischarg ing for t he purpose of t a k i n g delivery of any such goods.

10. If any goods shall be landed on any such publ ic or p r iva te sufferance wharf and shal l no t be removed therefrom before t he expi­ ra t ion of for ty-eight hour s thereaf ter t h e Collector a t any publ ic wharf or t h e Whar f inge r a t any pr iva te sufferance wharf whereon such goods m a y t h e n be m a y remove a n d store t h e said goods in the Queen ' s or

a n y bonded or free wharehouse a t t he risk a n d cost of t h e consignee or

impor t e r thereof subject to a n y l ien b y t h e owner mas te r or agen t of t h e vessel for f reight or charges wh ich m a y be payable on such goods.

passed in t h e seven teen th and e igh teen th years of H e r presen t Majes ty ' s
re ign chap te r one h u n d r e d a n d four A n d in t he case of s t eam vessels

t h e gross t onnage measu remen t shall be deemed to be t he t o n n a g e of such vessels for t he purposes of ascer ta in ing the t onnage rates leviable

u n d e r th is Act . 12.
12. N o t w i t h s t a n d i n g a n y t h i n g here in conta ined i t shal l be
lawful for t h e Governor w i t h t he advice of t he E x e c u t i v e Council to
abolish a l toge ther or to reduce t h e scale of wharfage or t o n n a g e ra tes
prescribed by th is A c t a n d leviable t he r eunde r a t a n y publ ic whar f

whenever in his opinion i t shal l be to t he publ ic in teres t so to do.

13 . N o t h i n g in th i s A c t conta ined shal l be cons t rued so as to

abr idge or affect t he r i g h t of any vessel now ber thed a t any public wharf in respect of t he free lay days and other t he provisions contained

in t he A c t s he reby repealed.
14. Subjec t to t h e provisions of th is A c t i t shall be lawful for
the Governor w i th the advice of t he E x e c u t i v e Council to f rame

regu la t ions from t ime to t ime for t he following purposes :—

(1.) The be r th ing of vessels at a publ ic wharf
(2.) The removal of vessels from a publ ic wharf

(3.) The d ischarging of cargo and loading thereof and storage or

removal of goods merchandise packages and articles discharged

b y vessels or to be laden from a n y such publ ic wharf

(4.) The leasing of any publ ic wharf

(5.) A n d for prescr ibing penal t ies upon t h e cont ravent ion of any
such regula t ion and di rec t ing t h e mode of the i r recovery and
enforcement Provided t h a t no such penal ty shall exceed the
s u m of t w e n t y pounds and t h a t every pena l ty m a y be defined
by a m i n i m u m as well as a m a x i m u m l imi t
A n d a l l such regula t ions shall upon notification in t he Government
Gazette have t h e force of law A n d shall be laid before P a r l i a m e n t
w i th in fourteen days after such notification if P a r l i a m e n t be t h e n in
session a n d if no t t h e n wi th in four teen days after t h e commencemen t
of t h e n e x t ensu ing session.

15 . I t shall be lawful for t he Governor wi th t he advice of the Execu t ive Counci l to demise a n d let to farm by publ ic auc t ion in such m a n n e r and subject to such bonds wi th or wi thou t suret ies and to such covenants a n d condi t ions as t he Colonial Treasurer m a y t h i n k fit t he whar fage and tonnage rates payable a t any publ ic wharf in t he Colony or a t any defined port ion of such wharf for any t e r m not exceeding

five years .
16. A n y such lessee m a y levy demand a n d recover whar fage

rates according to t he scales in t he Second Schedule here to upon all goods merchandise packages and art icles landed a t such whar f or laden theref rom and also according to t he scale prescribed by section

six of th i s A c t and t h e exempt ion or free lay days t h e r e i n referred to
u p o n all vessels d i scharg ing cargo a t such wharf or occupying a be r th
the rea t B u t no such rates shal l exceed the respective scales specified

in t h e said Schedule or prescribed by th is Ac t .

17. D u r i n g such t e r m or t e rms as t h e said ra tes or any p a r t or

par t s thereof shall be so leased as aforesaid to any person or persons whomsoever i t shall be lawful for t h e lessee thereof to nomina te and appoin t such o ther person or persons as he m a y t h i n k necessary by wr i t ing u n d e r his h a n d to collect demand and take such ra tes so

demised leased and farmed A n d any such person so appoin ted m a y use

all lawful means for t h e recovery thereof in case of n o n - p a y m e n t or evasion as such lessee himself could do by law and may appoin t such persons as he m a y t h i n k necessary b y wr i t ing unde r his h a n d as wharf ingers or o ther servants Provided however t h a t such lessee shall be answerable for t h e conduct of every person so appoin ted by h i m as aforesaid and shall be liable for neglect or misconduct or for t h e broach of any law or regula t ion respect ing t he rates commit ted by any collector or collectors of such ra les as fully to all in tents and purposes as if t h e same h a d been commi t t ed by such lessee.

18. N o t w i t h s t a n d i n g a n y t h i n g in t he " Naviga t ion A c t fur ther
A m e n d m e n t A c t of 1879" i t shal l be lawful for t he Colonial Treasurer
to let a n y j e t t y or pier s i tuate at t h e Circular Q u a y or a n y por t ion

thereof a t such r en t or pr ice and w h e t h e r for t h e whole of such j e t t y or p ier or for a n y por t ion of t h e whole f rontage thereof as he m a y t h i n k best in t h e publ ic in teres t a n d whe the r by publ ic auct ion or

p r iva te cont rac t Provided always t ha t t he power of revok ing leases and
for the i r r egu la t ion by the Mar ine Board conta ined in t h e th i rd section

of t h e said A c t shall apply to any leases g ran ted u n d e r th is section.
