Transmission of business.

[1] By application dated 9 February 2010 Westpac Banking Corporation (Westpac) sought orders pursuant to s.319 of the Fair Work Act 2009 (the Act) to ensure that there was appropriate industrial regulation for both Westpac and St.George Bank Limited (St.George).

[2] A decision issued on 29 January [2010] FWA 611 1 related to similar application and provides a background explanation to this application.

[3] Against the background of my earlier decision and the submissions made by Westpac and the Finance Sector Union of Australia (FSU) during proceedings in relation to this matter I am satisfied that provision s.319(3) of the Act has been satisfied and I will issue a consent order in the terms sought. The order will be reflected in PR993931.
