REASONS FOR DECISION TO DISMISS OBJECTION APPLICATION
[1] On the dates specified in the attached Schedule, the Government party gave notice under s 29 of the Native Title Act 1993 (Cth) of its intention to grant various exploration and prospecting permits (the proposed tenements) to the grantee parties specified therein and included in the notice a statement that it considered the grants attracted the expedited procedure.
[2] On the dates specified in the attached Schedule, Western Desert Lands Aboriginal Corporation (the native title party) made expedited procedure objection applications in relation to the proposed tenements.
[3] On 15 November 2012, the Department of Mines and Petroleum on behalf of the Government party, advised the Tribunal that under s 32(7) of the Native Title Act 1993 (Cth), the Government Party withdrew its statement that the tenements named in the attached schedule attracted the expedited procedure.
[4] Accordingly, the named tenements are to be treated under s 31(1) of the Native Title Act 1993 (Cth) and the objection applications are no longer valid.
Decision
[5] The objection applications named in the attached schedule are dismissed pursuant to s 148(a) of the Native Title Act 1993 (Cth).
