Enterprise agreement.
[1] On 23 May 2012, Western Australian Shed Commercial Pty Ltd (“the Applicant”) made application for approval of a single enterprise agreement to be known as the WA Shed Commercial Pty Ltd Company Policy Agreement 2012 (“the Agreement”). The application was made pursuant to s.185 of the Fair Work Act 2009 (“the FW Act”).
[2] On 15 June 2012, my Associate informed the Applicant, by email, that I had made a preliminary review of the application and sought comments on 10 aspects of the proposed enterprise agreement.
[3] On 6 July 2012, my Associate sought a response to her email of 15 June 2012.
[4] On 13 July 2012, my Associate received an email from the Applicant apologising for the delay and advising that a response would be completed by 20 July 2012.
[5] As no response was received from the Applicant, my Associate, on 6 September 2012, emailed seeking a response.
[6] On 17 October 2012, my Associate advised the Applicant that if a response to my queries was not received by 22 October 2012, I would deem the application discontinued. No response was received by 22 October 2012.
[7] Pursuant to paragraph 587(3)(a) of the FW Act and for the reasons outlined above, the application is dismissed for want of prosecution.
