No. 23 of 1973.

AN ACT to amend the Western Australian Marine Act, 1948-1972, to make provision for the licens- ing of air cushion vehicles, to require owners of certain vessels to insure against liability in respect of the deaths or bodily injuries caused to passengers in those vessels by the use of those vessels, and for incidental purposes.

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

2. (1) Subject to subsection (2) of this section, this Act shall come into operation on a date to be fixed by proclamation.

(2) It is not necessary that the whole of this Act be proclaimed to come into operation on the one day; and the several sections may be proclaimed to come into operation on such respective days as are fixed by proclamation.

3. Subsection (1) of section 8 of the principal

Act is amended

(a)

by inserting before the interpretation of the term "agreement" a new interpretation as follows

"air cushion vehicle" means a vehicle which is designed to be supported when in motion wholly or partly by air expelled from the vehicle to form a cushion of which the boundaries include the water or other surface beneath the vehicle; ; and

(b)

as to the interpretation of the term "vessel", by adding after the word "boat" the words "or air cushion vehicle".

4. Section 17 of the principal Act is amended by adding after paragraph (iv) a new paragraph as follows-

(iva) prescribing the manner of operating, and regulating and controlling the use of, air cushion vehicles and for the inspection, testing, survey and registration of air cushion vehicles; .

5. Section 188 of the principal Act is amended stiegodar

by redesignating the section as subsection (1) and

adding a new subsection as follows

(2) It shall be a condition of every boat license granted by the Department in relation to an air cushion vehicle, or in relation to any vessel used to carry any passenger for a fare upon any inland waters of the State or within any harbour, that the owner

(a)

insures against any liability which may be incurred by him in respect of the death of or bodily injury to any person caused by or arising out of the use of such vessel; and

(b)

enters into a contract and maintains in force a policy of insurance in the approved form for that purpose. .
