AN ACT to amend the Western Australian Institute

of Technology Act, 1966.

[Assented to 4th November, 1968.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Western Australian Institute of Technology Act Amendment Act, 1968.

(2) In this Act the Western Australian Institute of Technology Act, 1966 is referred to as the principal Act.

The principal Act as amended by this Act may

be cited as the Western Australian Institute of

Technology Act, 1966-1968.

2. Section twenty of the principal Act is amended

by substituting for the word, "Council"

(a)

in line four of subsection (1);

(b)

in line one of subsection (3); and

(c) in line four of subsection (4),

the word, "Institute".

3. Section thirty-one of the principal Act is

amended

(a)

by substituting for the word, "Council", being the last word in line three of subsec- tion (1), the word, "Institute"; and

(b)

by repealing and re-enacting subsection (2) as follows

(2) The Institute shall hold and use

the land so vested under and subject to

this Act and for the purposes thereof. .

4. Section thirty-three of the principal Act is

amended by substituting for the word, "Council"

(a)

in line two of subsection (1); and

(b) in line three of subsection (2),

the word, "Institute".

5. Section thirty-four of the principal Act is

amended

(a) by repealing paragraph (i) of subsection

(1) and re-enacting it as follows-

(i) the fees to be charged for courses of study or instruction, examinations, diplomas and certificates of the Institute and for such other facilities or privileges of the Institute as are prescribed; ; and

(b)

by adding after subsection (1) a subsection as follows

(la) All fees imposed by or paid to the Council or the Institute before the com- mencement of this subsection, shall be deemed to be lawfully imposed or collected under this Act. .

Subsection (2) of section thirty-six of the principal Act is repealed and re-enacted as follows

amended.

(2) The appointed date shall not be earlier than the 1st January, 1969 and not later than the 31st March, 1969. .

7.    The principal Act is amended by adding after S.44 added.

section forty-three a section as follows-

44. (1) For the purposes of this Act, there shall be established, upon the making, under section thirty-four of this Act, of the Statute referred to in subsection (4) of this section, an organised association of enrolled students by the name of the Student Guild.

(2) When established, the Student Guild shall be a body corporate by that name and under that corporate name

(a) shall have perpetual succession;

(b) shall have a common seal;

(c)

may sue and be sued in any court;

(d)

may do and suffer all other acts and things that bodies corporate may by law do and suffer; and

(e)

shall be the recognised means of communication between the enrolled students and the Council.

(3) The primary function of the Student Guild is to further the common interests of its members.

(4) For the purposes of this section a Statute

shall be made prescribing

(a)

the conditions of membership of the Student Guild; and

(b)

in addition to the function referred to in subsection (3) of this section, the powers, duties and functions of the Student Guild,

and the Statute may prescribe such other matters and things as are necessary or convenient for the effective exercise of those powers, duties and functions. .

8. The Schedule to the principal Act is amended by substituting for the word, "Council", in line five the word, "Institute".
