Act N o . 1 6 1 , 1979 .

An Act to amend the Wentworth Irrigation Act to enable drainage works to be constructed in the irrigation area; and for other purposes. [Assented to, 10th December, 1979.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

1. This Act may be cited as the "Wentworth Irrigation

(Amendment) Act, 1979".

2.       (1) This section and section 1 shall commence on the date

of assent to this Act.

(2) Except as provided in subsection ( 1 ) , this Act shall commence on the day appointed and notified under section 2 (2) of the Water (Amendment) Act, 1979.

3. The Wentworth Irrigation Act is amended by inserting after

section 31 the following section :—

31A. (1 ) Notwithstanding anything recited in the

preamble to this Act—

(a)	the Commission has, and shall be deemed always to have had, power to construct drainage works in
the irrigation area;
(b)	any drainage works constructed, before the day appointed and notified under section 2 (2) of the Water (Amendment) Act, 1979, in the Curlwaa Provisional Subsoil and Surface Drainage District shall be deemed to have been constructed under this Act; and
(c)	anything done, before the day appointed and notified under section 2 (2) of the Water (Amend­ ment) Act, 1979, in respect of the construction of drainage works in the irrigation area is validated.

(2) The provisions of Part VI of the Water Act, 1912, in so far as they apply to and in respect of drainage works constructed under that Part, shall apply to and in respect of drainage works constructed under this Act in the same way as they apply to and in respect of drainage works constructed under that Part.

In respect of drainage works constructed, before the day referred to in section 2 ( 2 ) , under Part VIII of the Water Act, 1912, in the Curlwaa Provisional Subsoil and Surface Drainage District, the Water Resources Commission constituted under section 4 of the Water Resources Commission Act, 1976, may. by notification published in the Gazette, waive any rate, or the balance of any contribution, payable under Part VIII of the Water Act, 1912, and outstanding immediately before that day, and the waiver has effect as if that rate or balance had been paid.
