WENTWORTH IRRIGATION ACT 1890—REGULATION

(Relating mainly to leases to be granted under the Act)

HIS Excellency the Governor, with the advice of the Executive Council,

and in pursuance of the Wentworth Irrigation Act 1890, has been pleased

to make the Regulation set forth hereunder.

The Wentworth Irrigation Regulations 1926 are amended:

(a) by omitting from the definition of “Returned soldier” in Regulation 2 and from Regulations 3–7, 9, 13–15, 17, 18 and 20–35 and from Form IV in Schedule “A” the word “Commission” wherever occurring and by inserting instead the words “Ministerial Corporation”;
(b) by omitting Regulation 16 and by inserting instead the following Regulation:

Lease to be executed

16. Within 3 months after the notification of the Ministerial Corporation’s acceptance of any application for a lease, or within such longer period as the Ministerial Corporation may allow, the applicant must execute a lease in a form approved by the Ministerial Corporation.

(c) by omitting Regulation 36;

(d) by omitting from Form I in Schedule ‘‘A” the words “Water Resources Commission” wherever occurring and by inserting instead the words “Water Administration Ministerial

Corporation”;

(e) by omitting Forms III and V from Schedule “A”;

(f) by omitting from Form IV in Schedule “A’ the words “Water
Resources” wherever occurring and by inserting instead the words
“Water Administration”;
(g) by omitting from Form IV in Schedule “A” the words “The

WATER RESOURCES COMMISSION” wherever occurring.

EXPLANATORY NOTE

At present, the Wentworth Irrigation Regulations 1926 require the successful applicant for a lease of land to which the Regulations apply to execute a lease in a prescribed form.

The object of this Regulation is to amend those Regulations so as to allow the execution of a lease in any form approved by the Ministerial Corporation.

The Regulation also inserts references to the Water Administration Ministerial Corporation constituted by the Water Administration Act 1986 in place of references to its predecessors and deletes an obsolete Regulation and two Forms which are longer required.
