Regulations under the Weights and Measures

Ordinance 1929-1933.

-L, in pursuance of the powers conferred by the Seat of Government (Administration) Ordinance 1930-1933 and the' Weights and Measures Ordinance 1929-1933, hereby make the following Regulations to come into operation upon the date of the commencement of the Weights and Measures Ordinance 1932.

WEIGHTS AND MEASURES REGULATIONS.

1. These Regulations may he cited as the Weights and Measuree short title.

2. The application of the Regulations' "under the Weights and Modiflcation,

Measures Act, 1915 of the State of New South Wales, as applied by the fc^tton

Weights and Measures Ordinance 1932, shall be subject to the following under Weighu

modifications, adaptations and exceptions:— ™< IOIT"" '

(a) The regulations shall be read—

(i) aa if the words " the date of the Regulations " were substituted "for the words "6 th July, 1917" (wherever occurring) ; and

(ii) as if the words " in pursuance of section 27 of the
Ordinance "during a period of five" were sub-

1                 stituted for the words " by section 31 of the Act

<r-- during a period of twenty" (wherever

•' " occurring);

(b) Regulation 2 of P a r t I . shall be read as if the following •words were omitted :—

" P a r t V I I I . — S a l e of Coal and Firewood.

" P a r t IX.—Regist ra t ion of Public Weighbridges and

Licensing of Weighmen.";

(c) Regulation 3 of P a r t I . shall be read—

( i ) as if the words " F i r s t day of August, 1933," were substituted for the words " first day of August, 1917 " ; and

( i i ) as if, at the end thereof, the following definition

were inserted:—

" the Ord inance" means the Weights and

Measures Ordinance 1929-1933;

(d ) Regulation 1 of P a r t I I . shall be read as if, after the words " Colonial Treasurer ", the words " of that State " were inserted:

(e) Regulation 2 of P a r t I I I . shall be read as if, in sub-

paragraph (4) of paragraph ( e ) , the word " O r d i n a n c e "

were substituted for the word " Act " ;

( / ) Regulation 49 of P a r t I V . shall be read—

(i) as if the following proviso were substituted for the proviso to sub-paragraph (2) of para- graph (e) :—

" Provided that, in the case of instruments stamped, in pursuance of the Weights and Measures Act 1898 of the State of New South "Wales, prior to the first day of January , 1926, the instruments may be restamped if the knife edge shanks are firmly and securely fitted.";

( i i ) as if the following proviso were substituted for the proviso to paragraph (g) :—

" Provided that instruments stamped in pur- suance of the Weights and Measures Act 1898 of the State of New South Wales prior to the first day of J anua ry , 1926, may be restamped."; and

(i i i) as if the following proviso were substituted for the words " and shall not take effect unti l the first day of January , 1926, or preclude the restaraping thereafter of instruments stamped prior to such date if the indications of the instruments are clearly readable " in the proviso to sub-paragraph (2) of paragraph ( / ) :—

" : Provided further that instruments stamped in pursuance of the Weights and Measures Act 1898 of the State of New South Wales prior -to the first day of January , 1926, may be restamped if the indications of the instruments are clearly readable.";

(g) Regulation 53 of P a r t I V . shall be read as if the following proviso were substituted for the proviso to para- graph (c) :—

"Prov ided that instruments stamped in pursuance of the Weights and Measures Act 1898 of the State of New South Wales prior to the first day of January , 1926, may be restamped.";

(7i) Regulation 69 of P a r t I V . shall he read as if the following- proviso were substituted for the proviso to para- graph (d) :—

" Provided that instruments stamped in pursuance of the Weights and Measures Act 1898 of the State of New South Wales prior to the first day of January , 1926, may be restamped.";

( i ) Regulation 75 of P a r t IV . shall be read as if the following proviso were substituted for the proviso to para- graph (c) :—

" Provided that instruments stamped in pursuance of
the Weights and Measures Act 1898 of the S ta te of New

South Wales prior to the first day of January , 1926 may

be r e s t a m p e d " ;

( ; ) Regulation 7 6 A of P a r t I V . shall be read as if the following proviso were substituted for the proviso thereto:—

"Prov ided that instruments stamped in pursuance of the Weights and Measures Act 1898 of the State of New South Wales prior to the first day of January , 1926 may be restamped.";

(k) The heading to regulation 89 of Part IV. shall be read as

if the words " and Weighbridges " were omitted;

(1)' Kegulations 91, 92 and 93 of Part IV. shall be read as if

the words " or weighbridge " were omitted;

(TO) Kegulations 94 to 97 (inclusive) of Part IV. are excepted; («•) Regulation 112 of Part IV. shall be read as if, after the

word " Office," the word " Sydney " were inserted;

(o) Regulation 115 of Part IV. shall be read as if the word " Superintendent's" were substituted for the word " metropolitan " ;
(p) Regulation 117 of Part IV. shall be read as if the words " In the Metropolitan Weights and Measures District" and the proviso thereto were omitted;

(q) Regulation 118 of Part IV. is excepted;

(r) Regulation 121 of Part IV. shall be read— '

(i) as if the words " Commonwealth or the Common- wealth Railways Commissioner " were substituted for the words " Railways Commissioners or other Government Department"; and

(ii) as if the words " Commonwealth or the Com- missioner " were substituted for the words " Commissioners of such Department " ;

(s) Regulation 122 of Part IV. shall be read as if the words "Act, Sections 30 (1) and 57 (p)" were omitted from the heading thereto;

(t) Regulations 123 to 129 (inclusive) of Part IV. and the

headings thereto are excepted;

(«) Regulation 2 of Part V. shall be read as if the word

" Ordinance " were substituted for tho word " Act " ;

(v) Part VI . shall be read as if the words " Act, section 57,

sub-section (1)" in the heading thereto were omitted;

(w) Regulation 1 of Part VI. shall be read as if the words " same meaning as in the Public Health Ordinance 1928- 1930 " were substituted for the words "meaning assigned thereto by the Pure Poods Act, No. 31, 1908, section 4 " ;
(x) Regulation 3 of Part VI. shall be read as if paragraph

(a) were omitted;

(y) Part V I A . shall he read as if the words "Act, section 25 sub-sections 1 and 4 (a) " in the heading thereto were omitted;

(z) Regulation 1 of Part VIA. shall be read as if the words "sub-sections (1.) and (2.) of section 21 of the Ordinance " were substituted for the words " section 25, sub-sections (1) and (2) of the Ac t " ;

(aa) Part VII . shall be read as if the words "Act, section

25 (3) and 57 (q)" in the heading thereto were omitted;

(bb) Regulation 1 of Part VII . shall be read—

(i) as if the words " sidi-section (3.) of section 21 of the Ordinance " were substituted for the words "The Act, section 25 (3 )" ; and

(ii) as if, in paragraph (d), the words "sub-section (1.) of section 19, of the Ordinance" were sub-	stituted for the words " section 23 (1) of the
Act" ;

(cc) Regulation 5 of Part VII. shall be read—

(i) as if the words "sub-section (3.) of section 21 of the Ordinance " were substituted for the words "section 25 (3) of the Act" ; and

(ii) as if, after the words "Fruit Cases Act, No. 72, 1912 ", were inserted the words " of the State of Few South Wales";

(dd) Part VI I I . and Part IX. of the Regulations are excepted; (ee) Regulation 1 of Part X. shall be read as if the words

" twenty-one of the Ordinance " were substituted for the

words " twenty-five of the Act " ;

(//) Regulations 3 and 4 of Part X. are excepted; and

(gg) Table X I I . of Part X. shall be read as if the words " Second Schedule to the Ordinance" were substituted for the words " Act, Schedule B ".
