REGULATIONS UNDER THE WEIGHTS AND MEASURES (NATIONAL STANDARDS) ACT 1960-1964.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Weights and Measures (National Standards) Act 1960-1964.

Amendments of the Weights and Measures (National Standards) Regulations.

Date on which certain regulations take effect.

1. Regulations 4 to 17 (inclusive), and sub-regulations (1.) to (4.) (inclusive) of regulation 23 of, and Parts I. to IV. (inclusive) of the Schedule to, these Regulations shall take effect on the date on which Part II. of the Weights and Measures (National Standards) Regulations takes effect.

Parts.

2. Regulation 2 of the Weights and Measures (National Standards) Regulations is amended by omitting the words—

“Part III.—Standards of Measurement (Regulations 77-81).”

and inserting in their stead the words—

“Division 28.—Activity of Radioactive Nuclides (Regulations 76a-76b).

“Division 29.—Exposure to Electromagnetic Radiation (Regulations 76c-76d).

“Part III.—Standards of Measurement (Regulations 77-82).”.

Interpretation.

3. Regulation 3 of the Weights and Measures (National Standards) Regulations is amended by omitting from the definition of “the Act” in sub-regulation (1.) the figures “1960” and inserting in their stead the figures “1960-1964”.

Units specified in the Fifth Schedule.

4. Regulation 16 of the Weights and Measures (National Standards) Regulations is amended by omitting from sub-regulation (1.) the words “, the litre”.

5. Regulations 17 and 18 of the Weights and Measures (National Standards) Regulations are repealed and the following regulations inserted in their stead:—

The cubic metre, cubic yard, &c.

“17.—(1.) The cubic metre is the volume of a cube each side of which is one metre in length.

“(2.) The cubic yard is the volume of a cube each side of which is one yard in length.

“(3.) The gallon is 0.00454609 cubic metre.

Conversion factors.

“18. For all legal purposes—

(a) one cubic yard shall be deemed to be equal to 0.764555 cubic metre; and

(b)one gallon shall be deemed to be equal to 277.42 cubic inches.”.

The cord, the superficial foot and the acre-foot.

6. Regulation 20 of the Weights and Measures (National Standards) Regulations is amended by adding at the end thereof the following sub-regulation:—

“(4.) The superficial foot may be referred to by the abbreviation ‘super foot’ or ‘super ft’.”.

Units of measurement of density.

7. Regulation 21 of the Weights and Measures (National Standards) Regulations is amended by omitting from sub-regulation (1.) the words “the kilogramme per litre,”.

The kilogramme per cubic metre, pound per cubic foot, &c.

8. Regulation 22 of the Weights and Measures (National Standards) Regulations is amended by omitting sub-regulation (2.).

Conversion factors.

9. Regulation 23 of the Weights and Measures (National Standards) Regulations is amended by omitting paragraph (a).

Units of measurement of velocity and speed.

10. Regulation 29 of the Weights and Measures (National Standards) Regulations is amended by inserting in sub-regulation (2.), after the word “abbreviation”, the words “(if any)”.

Units of measurement of acceleration.

11. Regulation 32 of the Weights and Measures (National Standards) Regulations is amended by inserting in sub-regulation (3.), after the word “abbreviation”, the words “(if any)”.

12. Regulation 44 of the Weights and Measures (National Standards) Regulations is repealed and the following regulation inserted in its stead:—

Units of measurement of pressure.

“44.—(1.) The units of measurement of pressure are—

(a)the units specified in the first column of the Fifteenth Schedule; and

(b) the inch of mercury.

“(2.) The units of measurement of pressure specified in the first column of the Fifteenth Schedule are related to the newton per square metre, the pound-force per square inch, the centimetre of mercury or the inch of water, as the case may be, as respectively specified in the second column of that Schedule.

“(3.) A unit of measurement of pressure specified in the first column of the Fifteenth Schedule may be referred to by the abbreviation (if any) specified in the third column of that Schedule opposite the reference to that unit in the first column.

“(4.) The inch of mercury may be referred to by the abbreviation ‘inHg’.”.

13. Regulation 51 of the Weights and Measures (National Standards) Regulations is repealed and the following regulation inserted in its stead:—

Units of measurement of electric charge.

“51.—(1.) The units of measurement of electric charge are the coulomb and the ampere hour.

“(2.) The coulomb and the ampere hour may be referred to by the abbreviations ‘C’ and ‘Ah’, respectively.”.

The coulomb and the ampere hour.

14. Regulation 52 of the Weights and Measures (National Standards) Regulations is amended by adding at the end thereof the following sub-regulation:—

“(2.) The ampere hour is 3,600 coulombs.”.

15. Regulations 58 and 59 of the Weights and Measures (National Standards) Regulations are repealed and the following regulations inserted in their stead:—

Units of measurement of electrical conductance.

“58.—(1.) The units of measurement of electrical conductance are the siemens, the microsiemens, the mho and the micromho.

“(2.) The siemens may be referred to by the abbreviation ‘S’ and the microsiemens may be referred to by the symbol ‘µS’.

The siemens, mho, &c.

“59.—(1.) The siemens or the mho is the electrical conductance of a conductor that has an electrical resistance of one ohm.

“(2.) The microsiemens or the micromho is 0.000001 siemens.”.

Units of measurement of illumination.

16. Regulation 71 of the Weights and Measures (National Standards) Regulations is amended by adding at the end thereof the following sub-regulation:—

“(6.) The lux may be referred to by the abbreviation ‘lx’.”.

17. After regulation 76 of the Weights and Measures (National Standards) Regulations the following headings and regulations are inserted in Part II.:—

“Division 28.—Activity of Radioactive Nuclides.

Units of measurement of the activity of radioactive nuclides.

“76a.—(1.) The units of measurement of the activity of radioactive nuclides are the curie, the millicurie, the microcurie and the picocurie.

“(2.) The curie, the millicurie and the picocurie may be referred to by the abbreviations ‘Ci’, ‘mCi’ and ‘pCi’, respectively, and the microcurie may be referred to by the symbol ‘µCi’.

The curie, the millicurie, &c.

“76b.—(1.) The curie is the activity of a radioactive nuclide that is undergoing 3.7 × 1010 disintegrations per second.

“(2.) The millicurie is 0.001 curie.

“(3.) The microcurie is 0.000001 curie.

“(4.) The picocurie is 0.000000000001 curie.

“Division 29.—Exposure to Electromagnetic Radiation.

Units of measurement of exposure to electromagnetic radiation.

“76c.—(1.) The units of measurement of exposure to electromagnetic radiation are the roentgen, the milliroentgen and the microroentgen.

“(2.) The roentgen and the milliroentgen may be referred to by the abbreviations ‘R’ and ‘mR’, respectively, and the microroentgen may be referred to by the symbol ‘µR’.

“76d.—(1.) The roentgen is the exposure to electromagnetic radiation in respect of which the sum of the electrical charges on all the ions of one sign produced in air is equal to 2.58 x 10-4 coulomb per kilogramme of the mass of a volume of air when all the negatrons and positrons liberated by the electromagnetic radiation in that volume of air are completely stopped in air.

“(2.) The milliroentgen is 0.001 roentgen.

“(3.) The microroentgen is 0.000001 roentgen.”.

18. Regulation 78 and 79 of the Weights and Measures (National Standards) Regulations are repealed and the following regulations inserted in their stead:—

Marks to be stamped on or affixed to standards of measurement.

“78.—(1.) Subject to this regulation, a standard of measurement shall not be verified or reverified under these Regulations unless—

(a)a distinguishing mark has been stamped or otherwise legibly and permanently affixed on or to it before it is verified or reverified; or

(b)there is stamped or otherwise legibly marked on or affixed to it, immediately after it has been verified or reverified, a mark indicating the date on which it was verified or reverified and, if such is the case, that it is to be deemed to be of a value equal to its denomination in accordance with regulation 82 of these Regulations.

“(2.) The last preceding sub-regulation does not apply in relation to a standard of measurement if it is impracticable, by reason of its size or nature, so to stamp or affix a mark referred to in paragraph (a) or (b) of the last preceding sub-regulation on or to it.

Verification, &c., of standards of measurement referred to in section 8 of the Act.

“78a.—(1.) Where a standard of measurement referred to in section 8 of the Act is verified or reverified—

(a)in the case of a verification or reverification carried out by the Organization—an officer or employee of the Organization authorized by the Organization in writing to sign and issue certificates under this regulation; or

(b)in any other case—any person authorized by the Organization in writing to sign and issue certificates under this regulation,

may sign and issue such a certificate with respect to the verification or reverification of the standard of measurement.

“(2.) There shall be stated in every such certificate—

(a)the date on which the standard of measurement was verified or reverified;

(b) the accuracy with which the standard was verified or reverified;

(c) a description of the mark (if any) appearing on the standard as referred to in the last preceding regulation;

(d)the value, in terms of a Commonwealth legal unit of measurement or Commonwealth legal units of measurement, of the standard as ascertained on the date referred to in paragraph (a) of this sub-regulation; and

(e)that the standard is a Commonwealth standard of measurement or a working standard of measurement, as the case may be.

“(3.) For the purposes of paragraph (b)of the last preceding sub-regulation, the accuracy of the standard of measurement shall be ascertained and expressed in such manner as the Organization from time to time determines.

“(4.) This regulation does not apply to a special standard of measurement referred to in sub-section (2a.) of section 8 of the Act.

Verification, &c., of standards of measurement to which section 9 of the Act applies.

“79.—(1.) Where a standard of measurement to which section 9 of the Act applies is verified or reverified in accordance with that section—

(a) in the case of a verification or reverification carried out by the Organization—an officer or employee of the Organization authorized by the Organization in writing to sign and issue certificates under this regulation; or

(b)in any other case—any person authorized by the Organization in writing to sign and issue certificates under this regulation,

may sign and issue such a certificate with respect to the verification or reverification of the standard of measurement.

“(2.) There shall be stated in every such certificate—

(a) the date on which the standard of measurement was verified or reverified;

(b)the accuracy with which the standard was verified or reverified;

(c) a description of the mark (if any) appearing on the standard as referred to in regulation 78 of these Regulations;

(d)the value, in terms of a Commonwealth legal unit of measurement or Commonwealth legal units of measurement, of the standard as ascertained on the date referred to in paragraph (a) of this sub-regulation;

(e) the period specified under sub-section (3.) of section 9 of the Act as the period within which the standard is to be reverified or reverified again; and

(f) that the standard was verified or reverified in accordance with section 9 of the Act.

“(3.) For the purposes of paragraph (b)of the last preceding sub-regulation, the accuracy of the standard of measurement shall be ascertained and expressed in such manner as the Organization from time to time determines.”.

Verification, &c., of standards of measurement as subsidiary standards.

19. Regulation 80 of the Weights and Measures (National Standards) Regulations is amended—

(a)by omitting from sub-regulation (2.) the words “and, if it is carried out by, or under the supervision of, a verifying authority, is a manner for the time being approved by the Commission for the purpose”;

(b)by omitting from paragraph (a) of sub-regulation (6.) the words “for the purpose by the Organization or the verifying authority, as the case may be “and inserting in their stead

the words “by the Organization or the verifying authority, as the case may be, to sign and issue certificates under this regulation”; and

(c) by omitting sub-regulations (7.), (8.) and (9.) and inserting in their stead the following sub-regulations:—

“(7.) There shall be stated in every such certificate—

(a) the date on which the standard of measurement was verified or reverified;

(b) the accuracy with which the standard was verified or reverified;

(c)a description of the mark (if any) appearing on the standard as referred to in regulation 78 of these Regulations;

(d)the value, in terms of a Commonwealth legal unit of measurement or Commonwealth legal units of of measurement, of the standard as ascertained on the date referred to in paragraph (a) of this sub-regulation;

(e)if such is the case, that the standard is not to be deemed to be of a value equal to its denomination;

(f) the period within which the standard is to be reverified or reverified again; and

(g)that the standard was verified or reverified as a subsidiary standard of measurement—

(i) by the Organization; or

(ii) by, or under the supervision of, a specified verifying authority,

in accordance with these Regulations.

“(8.) For the purposes of paragraph (b)of the last preceding sub-regulation, the accuracy of the standard of measurement shall be ascertained and expressed in such a manner as the Commission from time to time determines.

“(9) For the purposes of the last preceding sub-regulation, the Commission may, from time to time, determine the manner in which the accuracy of a subsidiary standard of measurement shall be ascertained and expressed.

“(10.) Notice of a determination made under sub-regulation (8.) of this regulation shall be given, by or on behalf of the Commission, to all verifying authorities.”.

20. After regulation 80 of the Weights and Measures (National Standards) Regulations the following regulation is inserted:—

Certificates as evidence.

“80a.—(1.) A certificate issued under this Part is evidence of the matters stated in it.

“(2.) A document purporting to be such a certificate may be received in evidence in any court (whether exercising federal jurisdiction or not) or in proceedings before a person authorized by a law of a State or Territory of the Commonwealth, or by consent of parties, to hear, receive and examine evidence.”.

Cancellation of certificates.

21. Regulation 81 of the Weights and Measures (National Standards) Regulations is amended by omitting from sub-regulation (1.) the words “either of the last two preceding regulations” and inserting in their stead the words “regulation 78a, 79 or 80 of these Regulations”.

22. After regulation 81 of the Weights and Measures (National Standards) Regulations the following regulation is inserted:—

Permissible variations in certain subsidiary standards of measurement.

“82. A subsidiary standard of measurement of a denomination referred to in the first column of the Twenty-fourth Schedule that on verification or reverification is found not to be greater or less than its denomination by an amount exceeding the amount of permissible variation specified in the second column of that Schedule opposite the reference to its denomination in the first column shall be deemed to be of a value equal to its denomination unless the certificate issued under regulation 80 of these Regulations in respect of that verification or reverification states otherwise.”.

The Schedules.

23.—(1.) The Fifth Schedule to the Weights and Measures (National Standards) Regulations is repealed and the Schedule set out in Part I. of the Schedule to these Regulations inserted in its stead.

(2.) The Tenth and Eleventh Schedules to the Weights and Measures (National Standards) Regulations are repealed and the Schedules set out in Part II. of the Schedule to these Regulations inserted in their stead.

(3.) The Fifteenth Schedule to the Weights and. Measures (National Standards) Regulations is repealed and the Schedule set out in Part III. of the Schedule to these Regulations inserted in its stead.

(4.) The Schedules to the Weights and Measures (National Standards) Regulations specified in the first column of Part IV. of the Schedule to these Regulations are amended as respectively specified in the second column of that Part.

(5.) The Weights and Measures (National Standards) Regulations are amended by adding at the end thereof the Schedule set out in Part V. of the Schedule to these Regulations.
