14036 WATER-WEIGHTS AND MEASURES. vlieights and ivleasures Acts Amendment Act. 22 GEO. V. No. 8, Authority in the due exercise of its powers, duties, and responsibilities may be continued and completed by the Local Authority. All the property, whether real or personal, and all other assets of whatever description and all liabilities, contracts, and engagements of the Water Authority shall, without any transfer, assignment, or conveyance or notice other than this Act, be diverted from such Water Authority and shall be vested in and shall attach to and be discharged by and may be enforced by or against the Local Authority." Discount by Water Authority. 3. Section one hundred and fourteen of the Principal Act is amended by adding the following new subsection three :- " (3.) The Water Authority may allow to any person liable to pay any rates, who pays the whole of such rates within thirty days after notice given to him to pay the same, a percentage by way of discount to be fixed by the by-laws, but not exceeding ten pounds per centum of the amount of such rates." This Act may be cited as "The Weights and Measures Acts Amendment Act of 1931," and shall be read as one with *" The Weights and Measures Acts, 1924 to 1930," herein referred to as the Principal Act. The Principal Act and this Act may collectively be cited as " The Weights and Measures Acts, 1924 to 1931." * 15 Geo. V. No. 2, 8upra, page llll6; and 21 Geo. V. Section eighteen of the Principal Act is amended Amenrlm.mt by deleting the words " Chief Inspector," where they twice of s. 18. occur, and inserting in lieu thereof the word" inspector" ; also in the sidenote to the section, the words "Chief Inspector" are repealed and the word "inspector" is inserted in lieu thereof. 3. Section nineteen of the Principal Act is amended Amendment as follows :_ of s. 19. (i.) A new paragraph (e) is inserted in subsection one of the said section, namely :- I " (e) Search for, examine, and in the presence Premises of the baker or of any servant or agent ?f ~ ~ ~ ~ c~ : d for the baker, or any person apparently m bread short charge of the premises, weigh any bread of, w~ ight t herel. n Wh l ' C h has been baked W.IthI' n eI.ghteen whoIuthrsma1ft8er hours next preceding the time of search, and baking. may search for, examine, and weigh any such bread in or on any vehicle or other means used for the transit or delivery of bread in any place. Such bread shall be weighed in sets of four loaves of the same denomination or size, or in any larger or smaller quantity, as may be found most convenient. In case of dispute the proof of the bread not having been baked within eighteen hours shall lie upon the baker." (ii.) After subsection two of the said section nineteen, the following new subsection is inserted, namely : - " [2A.] If on the weighing of such bread, as referred Pena:lty for to in paragraph (e) of subsection one of this section, any ~ ~ ~ ~ t~ r of deficiency is found in its due weight on the average of the bread, whole weight of all the loaves of bread of the same denomination or size which are then weighed, the inspector weighing the bread shall give to the baker or his servant or agent, or any person apparently in charge of the premises, who is present at the weighing a certificate in writing and signed by him showing the correct parti- culars of such weighing. The person offending shall be liable to a penalty not exceeding five shillings for every ounce of bread so

No. 8, found deficient, unless it is proved that the deficiency arose wholly from some unavoidable accident in baking or otherwise, or was occasioned by or through some contrivance or confederacy to injure the accused person." (iii.) Subsection three of the said section nineteen is amended by inserting after the words "seize such article" the words "and the court before which proceedings are taken may dispose thereof as it thinks fit"; also a new provision is added to the said subsection three, namely:- "Any inspector may seize all loaves of bread so found deficient (according to the provisions of sub- section 2A aforesaid), and the court before which proceedings are taken may dispose thereof as it thinks fit." New clause 4. The following new section is inserted after 25A. section twenty-five of the Principal Act as follows :- Brea.d to be "[25A.] All bread made for sale, except as herein- s o o f lcdemrtla? mavo8 after excepted ' shall be made into loaves weighing not weight. less than one pound, two pounds, or four pounds, according to the standard weight by law established, and such loaves shall be called the one-pound loaf, two-pounds loaf, and four-pounds loaf respectively. Any baker who- (i.) Makes for sale, or sells or exposes for sale bread of any other denomination or size; or (ii.) Sells or exposes for sale any loaf found to be deficient of its due weight, and which has been baked within .ejghteen hours next preceding the time of its being so sold or offered for sale ; shall be liable to a penalty not exceeding five pounds. In case of dispute, the proof of the bread not having been baked within eighteen hours shall lie on the baker: Provided that an bread weighing eight ounces or less shall be called and deemed to be rolls, and may be made and sold of such size or weight as the baker thinks fit."
WEIGHTS AND MEASURES. 14039 1931. Weights and Meas1lres Acts Arnendrment Act. 5. Section twenty-nine of the Principal Act is Amendment amended as follows :_ of s. 29. (i.) A new subsection is inserted after subsection one of section twenty-nine as follows : - " (2.) Every baker or vendor or vendors of bread Provisions as shall have in a convenient place, capable of being seen ~ c~akers, by the purchaser, a suitable weighing instrument with the necessary weights for weighing dough or bread. Any person who purchases any loaf of bread from any baker or vendor or vendors of bread may require the same to be immediately weighed in his presence, provided that this shall only apply where the bread is purchased at a bake-house or shop. Any baker or vendor or vendors of bread who neglects to have in a convenient place, capable of being seen by the purchaser, such suitable weighing instrument with the necessary weights, or who refuses to weigh any loaf purchased on his premises in the presence of the purchaser, shall be liable to a' penalty not exceeding five pounds." (ii.) Subsection two of the said section twenty-nine is now renumbered subsection three.
