WEATHERBURN
v
THE KING
[2024] HCASL 132
M20/2024
The applicant requires an extension of time within which to seek special leave to appeal from part of the judgment of the Court of Appeal of the Supreme Court of Victoria (McLeish, Taylor and Kaye JJA) which dismissed the applicant's appeal against sentence imposed by the County Court of Victoria (Judge Tinney).
The proposed appeal lacks sufficient prospects of success, and it is not in the interests of the administration of justice generally, or in this case, to grant special leave to appeal. It would be futile to grant the extension of time.
Special leave to appeal is refused.
