Weapons Prohibition Amendment (Law

Revision) Regulation 2011

Weapons Prohibition Act 1998

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Weapons Prohibition Act 1998.

Explanatory note
The objects of this Regulation are:

(a) to make it clear that silencers are subject to strict safe keeping requirements, and
(b) to correct cross-references to types of prohibited weapons specified in Schedule 1 to the Weapons Prohibition Act 1998.

This Regulation is made under the Weapons Prohibition Act 1998, including section 50 (the general regulation-making power).

Weapons Prohibition Amendment (Law Revision)

1      Name of Regulation

This Regulation is the Weapons Prohibition Amendment (Law
Revision) Regulation 2011.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Weapons Prohibition Regulation 2009

(1) Clause 18 Production permit

Omit “clause 2 (1)” from clause 18 (7). Insert instead “clause 1A (1)”.

(2) Clause 35A Safe keeping requirement levels
Omit “clause 4 (2)–(8)” from clause 35A (1) (d).
Insert instead “clause 4 (2) or (4)–(8)”.
(3) Schedule 1 Persons exempt from requirement for permit
Omit “clause 4 (4) (e)” from clause 5 (2) of the Schedule.
Insert instead “clause 4 (4) (f)”.
