I, the Minister for Planning, make the following local environmental plan under the
Environmental Planning and Assessment Act 1979.

1 Name of Plan
This Plan is Waverley Local Environmental Plan 2012 (Amendment No 8).
2 Commencement
This Plan commences on the day on which it is published on the NSW legislation website.
3 Land to which Plan applies
This Plan applies to the following land in Bondi Junction:
| (a) | Norman Lee Place (Boot Factory), |
| (b) | Oxford Street Mall (between Bronte Road and Newland Street), |
| (c) | Rowe Street (between Oxford Street Mall and Grosvenor Lane). |
4 Maps
The maps adopted by Waverley Local Environmental Plan 2012 are amended or replaced, as the case requires, by the maps approved by the Minister on the making of this Plan.
5 Amendment of Waverley Local Environmental Plan 2012

Omit “Despite any other provisions of this Plan, development consent must not be granted unless the consent authority is satisfied that there is no” from clause 6.7 (2).
Insert instead “Despite any other provision of this Plan, development consent must not be granted to development that results in any part of a building causing an”.

| (d) | Norman Lee Place (also known as the Boot Factory), other than the shadow that would be cast by a notional wall, with a vertical height of 20 metres, located on the southern boundary of any lot that adjoins the northern alignment of Spring Street, |
| (e) | Oxford Street Mall (between Bronte Road and Newland Street), other than the shadow that would be cast by a notional wall, with a vertical height that matches the relevant height on the Height of Buildings Map, located on the southern boundary of any lot that adjoins the northern alignment of Oxford Street. |
