Her Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Water Supply (Critical Needs) Act 2019.

Explanatory note

The objects of this Regulation are—

(a)	to declare the water supply for the locality that includes Bathurst, Raglan, Eglinton and Perthville and the area serviced by the Bathurst water supply system to be a critical town or locality water supply under the Water Supply (Critical Needs) Act 2019 (the Act), and
(b)	to prescribe certain development within that locality as development that is exempt from development control legislation (as defined in the Act) if the carrying out of the development is the subject of an authorisation of the Minister administering the Act.

This Regulation is made under the Water Supply (Critical Needs) Act 2019, including sections 5(2), 7(2) and 20 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Water Supply (Critical Needs) Amendment (Bathurst Water

Supply) Regulation 2020.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Water Supply (Critical Needs) Act 2019 No 16

(1) Schedule 1 Critical town or locality water supplies

Omit the note. Insert instead—

The locality that includes Bathurst, Raglan, Eglinton and Perthville and the area serviced by the Bathurst water supply system.

Schedule 2 Declared water supply development

Insert at the end of the Schedule—

Works for the Bathurst water supply system,	the locality that includes Bathurst, Raglan,
including a pumping station on the	Eglinton and Perthville and the area serviced
Macquarie River, a pre-treatment plant,	by the Bathurst water supply system

pipelines, processing ponds, storage ponds and additional pumping stations to transfer water to the existing Bathurst water filtration plant
