Act No. 143, 1986

An Act to amend the Water Act 1912 to omit certain provisions relating to the felling of trees near rivers and lakes, and for other purposes. [Assented to, 17 December 1986]

BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:

This Act may be cited as the

‘Water (Soil Conservation) Amendment

Act 1986”.

Commencement

2.         (1) Sections I and 2 shall commence on the date of assent to this

Act.

(2) Except as provided by subsection {1), this Act shall commence on the day appointed and notified under section 2 (2) of the Soil Conservation (Further Amendment) Act 1986.

Amendment of Act No. 44, 1912

3. The Water Act 1912 is amended by omitting sections 26d

(Destruction of trees in rivers and lakes) and 26da (Prevention of soil

erosion and repair of damage).

Savings

4. (1) A permit granted under section 26d of the Water Act 1912 before

the commencement of this Act shall be deemed to be an authority issued, and any conditions of that permit applying before that commencement shall be deemed to have been imposed, under section 21 n of the Soil Conservation Act 1938.

(2) An application fora permit under section 26d of the Water Act 1912 that has not been determined before the commencement of this Act shall be deemed to be an application for an authority under section 21d of the Soil Conservation Act 1938 and shall be determined accordingly.

IVater (Soil Conservation) Amendment 1986

(3) If an objection was lodged under section 26da of the Water Act 1912 and has not been disposed of before the commencement of this Act, that section applies to and in respect of the objection as if this Act had not been enacted.
