Water Sharing Plan for the NSW Great Artesian Basin Groundwater Sources Amendment Order 2013

Water Management Act 2000
I, the Minister for Primary Industries, in pursuance of section 45 (1) (a) of the Water Management Act 2000, being satisfied it is in the public interest to do so, make the following Order to amend the Water Sharing Plan for the NSW Great Artesian Basin Groundwater Sources 2008.

Explanatory note
This Order is made under section 45 (1) (a) of the Water Management Act 2000. The
object of this Order is to amend the Water Sharing Plan for the NSW Great Artesian
Basin Groundwater Sources 2008. The concurrence of the Minister for theEnvironment was obtained prior to the making of this Order.

Clause 43 Rules relating to constraints within a groundwater source
Omit clause 43 (3).Insert instead:
(3) Applications for dealings under sections 71Q, 71S and 71T of the Act in the Eastern Recharge Groundwater Source are prohibited until either the share components of aquifer access licences in these groundwater sources are reduced under clause 27 (1) or the commencement of year 6 of this Plan, whichever is sooner. (4) Applications for dealings under section 71W of the Act to nominate works in the Eastern Recharge Groundwater Source are prohibited until either the share components of aquifer access licences in these groundwater sources are reduced under clause 27 (1) or the commencement of year 6 of this Plan, whichever is the sooner. (5) Subclause (4) does not apply to a local water utility access licence or an access licence of
the subcategory “Town water supply”.
