Water Sharing Plan for the NSW Great Artesian Basin Groundwater Sources Amendment Order 2011

under the

Water Management Act 2000

I, the Minister for Primary Industries, in pursuance of section 45 (1) (a) of the Water Management Act 2000, being satisfied it is in the public interest to do so, make the following Order to amend the Water Sharing Plan for the NSW Great Artesian Basin Groundwater Sources 2008.

Explanatory note
This Order is made under section 45 (1) (a) of the Water Management Act 2000. The
object of this Order is to amend the Water Sharing Plan for the NSW Great Artesian

Basin Groundwater Sources 2008. The concurrence of the Minister for the

Environment was obtained prior to the making of this Order.

1.  Name of Order

This Order is the Water Sharing Plan for the NSW Great Artesian Basin
Groundwater Sources Amendment Order 2011.

2.  Commencement

This Order commences on the day on which it is published on the NSW legislation website.

3.  Amendment

The Water Sharing Plan for the NSW Great Artesian Basin Groundwater Sources
2008 is amended as set out in Schedule 1.

Schedule 1 Amendment of Water Sharing Plan for the NSW Great Artesian

Basin Groundwater Sources 2008

[1]      Clause 4 Area to which this Plan applies

Omit “as shown in Schedule 2”.

Insert instead “the registered map called The NSW Great Artesian Basin Groundwater Sources

Map 2011 (hereafter the Registered Map).

Note. An overview of the Registered Map is shown in Schedule 2. Copies of the Registered
Map may be inspected at the offices listed in Appendix 1.”

Omit subclause (1).

Omit “the plan called The NSW Great Artesian Basin Groundwater Sources” in subclause (2).

Insert instead “the Registered Map”.

Insert after subclause (2):

(3) Subject to subclause (5), the Southern Recharge Groundwater Source and the

Eastern Recharge Groundwater Source include all water contained in:

(a)	all rocks of Cretaceous, Jurassic and Tertiary age; and
(b)	all alluvial sediments;

within the Southern Recharge Groundwater Source and the Eastern Recharge
Groundwater Source boundaries as shown on the Registered Map.

(4) The Surat Groundwater Source, the Warrego Groundwater Source and the Central Groundwater Source include water contained in all rocks of Cretaceous and Jurassic age at a depth of more than 60 metres below ground level within the Surat Groundwater Source, Warrego Groundwater Source and Central Groundwater Source boundaries as shown on the Registered Map.

(5) These groundwater sources do not include any water contained in:

(a)	the waters to which the Water Sharing Plan for the Lower Gwydir Groundwater Source 2003 applies,
(b)	the waters to which the Water Sharing Plan for the Lower Macquarie

Groundwater Sources 2003 applies,

(c) the waters to which the Water Sharing Plan for the Upper and Lower Namoi

Groundwater Sources 2003 applies,

(d)	the waters to which the Water Sharing Plan for the Castlereagh below Binnaway Unregulated and Alluvial Water Sources 2011 applies,
(e)	the waters to which the Water Sharing Plan for the Intersecting Streams

Unregulated and Alluvial Water Sources 2011 applies,

(f) the waters to which the Water Sharing Plan for the NSW Great Artesian

Basin Shallow Groundwater Sources 2011 applies,

(g)	the waters to which the Water Sharing Plan for the NSW Murray Darling Basin Fractured Rock Groundwater Sources 2011 applies,
(h)	the waters to which the Water Sharing Plan for the NSW Murray Darling Basin Porous Rock Groundwater Sources 2011 applies,

(i)       any alluvial sediments within the excluded alluvial areas, as shown on the Registered Map.
