Water Services Coordination (Plumbers
Licensing) Amendment Regulations (No. 2) 2004
Made by the Governor in Executive Council.
Part 1 — Preliminary
1. Citation
These regulations may be cited as the Water Services
Coordination (Plumbers Licensing) Amendment Regulations
(No. 2) 2004.2. The regulations amended
" 5(2)(a) ".
The amendments in these regulations are to the Water Services
Coordination (Plumbers Licensing) Regulations 2000*.[* Published in Gazette 16 June 2000, p. 2897-936. For amendments to 6 May 2004 see Western Australian

Part 2— Amendments
3. Regulation 3 amended
Regulation 3 is amended in the definition of "chairperson" by deleting "6" and inserting instead —

4. Regulation 5 amended
(1) Regulation 5(1) is repealed. (2) Regulation 5(2) is repealed and the following subregulations are
inserted instead -
(2) The Board consists of 7 members -
(a)
one person appointed by the Minister to be a member and the chairperson of the Board;
(b)
one person with knowledge and experience of the plumbing industry appointed by the Minister from a panel of 3 names submitted by the Master Plumbers and Gas Fitters Association of Western Australia at the request of the Minister;
(c)
one person with knowledge and experience of the plumbing industry appointed by the Minister from a panel of names consisting of 3 names submitted by each of the relevant unions requested by the Minister to submit names;
(d)
one person with knowledge and experience of the plumbing industry appointed by the Minister from a panel of 3 names submitted by the Western Australian Drainage Association at the request of the Minister;
(e)
one person with knowledge of and experience in the plumbing industry appointed by the Minister; and
(0 two persons with the ability to represent the
interests of consumers nominated by the
Minister to whom the administration of the
Consumer Affairs Act 1971 is committed.
(2a) The Minister must ensure, to the extent practicable,
that the person appointed under subregulation (2)(a) is
not and has not been a participant in the plumbing
industry.(2b) The Minister must request at least one union to submit
names for the purposes of subregulation (2)(c).
(3) Regulation 5(3) is repealed and the following subregulation is
inserted instead -
(3) Each body that is requested to submit names under a
paragraph of subregulation (2) must submit 3 names of
persons suitable for appointment under the relevant
paragraph of subregulation (2).

(4) Regulation 5(4) is amended by deleting "(2)(e), (f), (g), (h) and
(i)" and inserting instead -" (2)(a) and (f), and the Minister referred to in
subregulation (2)(e) is to invite nominations, in the
manner determined by that Minister, for appointmentunder subregulation (2)(e)
(5) Regulation 5(5)(a) is amended by deleting "a request under". 5. Regulation 6 amended
Regulation 6(1) is repealed and the following subregulation is inserted instead -

(1) The Minister is to appoint one of the members to be the
deputy chairperson of the Board.
Note: The headings to regulation 6 will be altered by deleting Chairperson
and deputy" and inserting instead 'Deputy".
6. Schedule 2 amended
Schedule 2 clause 7 is amended by deleting "6" and inserting instead -
" 4 ,,
Part 3 - Transitional provisions
7. Current members to continue
(1) The person appointed as the Chairperson of the Board and
holding office immediately before commencement -
(a) continues to be Chairperson of the Board for the remainder of the period for which he or she was
appointed to be Chairperson; and(b)
is to be taken to have been appointed by the Minister under regulation 5(2)(a) of the Regulations as in force after commencement.
(2) The person appointed under regulation 5(2)(c) of the
Regulations as a member of the Board and holding office immediately before commencement -
(a)
continues to be a member of the Board for the remainder of the period for which he or she was appointed to be a member; and
(b)
is to be taken to have been appointed under regulation 5(2)(c) of the Regulations as in force after commencement.

(3) The person appointed under regulation 5(2)(d) of the
Regulations as a member of the Board and holding office immediately before commencement —
(a)
continues to be a member of the Board for the remainder of the period for which he or she was appointed to be a member; and
(b)
is to be taken to have been appointed under regulation 5(2)(d) of the Regulations as in force after commencement.
(4) The person appointed under regulation 5(2)(f) of the
Regulations as a member of the Board and holding office immediately before commencement —
(a)
continues to be a member of the Board for the remainder of the period for which he or she was appointed to be a member; and
(b)
is to be taken to have been appointed under regulation 5(2)(e) of the Regulations as in force after commencement.
(5) The person appointed under regulation 5(2)(h) of the
Regulations as a member of the Board and holding office immediately before commencement —
(a)
continues to be a member of the Board for the remainder of the period for which he or she was appointed to be a member; and
(b)
is to be taken to have been appointed under regulation 5(2)(f) of the Regulations as in force after commencement.
(6) In this Part —
"Board" means the Plumbers Licensing Board established
under the Water Services Licensing Act 1995;
"commencement" means the commencement of the Water
Services Coordination (Plumbers Licensing) Amendment Regulations (No. 2) 2004;
"Regulations" means the Water Services Coordination
(Plumbers Licensing) Regulations 2000.
