Water Services Coordination (Plumbers Licensing) Amendment Regulations 2001
Made by the Governor in Executive Council.
1. Citation
These regulations may be cited as the Water Services
Coordination (Plumbers Licensing) Amendment
Regulations 2001.2. The regulations amended
The amendments in these regulations are to the Water Services
Coordination (Plumbers Licensing) Regulations 2000*.[* Published in Gazette 16 June 2000, pp. 2897-936.]
3. Regulation 3 amended
Regulation 3 is amended as follows:
(a)
in the definition of "licence" by deleting "or tradesperson's licence" and inserting instead —

(b) by deleting "13" from the definition of "tradesperson's licence" and inserting instead — " 13(1) ";

(c) by inserting after the definition of "tradesperson's
licence" the following definition —

"tradesperson's licence (drainage plumbing)"
means a licence of the kind referred to in
regulation 13(2);4. Regulation 11 amended
Regulation 11 is amended as follows:
(a) after paragraph (a) by deleting "and"; (b)
after paragraph (b) by deleting the full stop and inserting —
G.4
; and
(c) a tradesperson's licence (drainage plumbing).
5. Regulation 13 amended
(1) Regulation 13 is amended by inserting before "A tradesperson's
licence" the subregulation designation "(1)".(2) At the end of regulation 13 the following subregulation is
inserted —44
(2) A tradesperson's licence (drainage plumbing)
authorises the holder to —
(a)
carry out the drainage plumbing work specified in the licence; and
(b)
supervise the carrying out of authorised work by an apprentice,
under the general direction and control of the holder of a plumber's licence.
6. Regulation 54 inserted
Alter regulation 53 the following regulation is inserted
54. Drainage plumbing work — transitional
arrangements(1) This regulation applies to a person who —
(a)
was engaged in carrying out drainage plumbing work on or after the day on which these regulations commenced;
(b)
does not hold a plumber's licence or a tradesperson's licence; and

(c)
does not comply with the requirements set Out in Schedule 3 in respect of a plumber's licence or a tradesperson's licence.
(2) If the person applies for a tradesperson's licence
(drainage plumbing) on or before 15 June 2001, then
until the licence is issued or the Board decides not to
issue the licence and notifies the person to that effect,
the person is to be treated for all purposes as if the
person was, at all material times, the holder of a
tradesperson's licence (drainage plumbing) that
authorised the person to carry out the drainage
plumbing work.(3) Subregulation (2) has effect despite regulations 9
and 10.

7. Schedule 1 amended
(1) Schedule 1 is amended in item 2 by inserting after
"tradesperson's licence" -
" or tradesperson's licence (drainage plumbing) ".(2) Schedule 1 is amended in item 4 by inserting after
"tradesperson's licence" -
" or tradesperson's licence (drainage plumbing) ".8. Schedule 3 amended
Schedule 3 is amended by inserting after item 3 the following item -
4. Tradesperson's licence (drainage plumbing)
The requirements for a tradesperson's licence (drainage
plumbing) are that the applicant -
(a)
was engaged in carrying out drainage plumbing work for part or all of the period of 5 years that ends
on the day on which the Water Services Coordination (Plumbers Licensing) Amendment Regulations 2001 commenced; and (b)
has sufficient experience and knowledge to qualify the applicant to carry out competently the drainage plumbing work that the applicant would be authorised to carry out under the licence.
