Enactments) (SWIMCO) Amendment

Regulations 1999

Made by the deputy of the Governor in Executive Council.

1.            Citation

These regulations may be cited as the Water Services Coordination (Extension of Enactments) (SWIMCO)

2.            Commencement

The commencement of these regulations is governed by section 46 of the Act.

3.            The regulations amended

The amendments in these regulations are to the Water Services Coordination (Extension of Enactments) (SWIMCO) Regulations 1997* [* Published in Gazette 9 May 1997, pp. 2314-19.]
4.	Regulation I amended Regulation 1 is amended by deleting "(SWIMCO)".

5.            Regulation 3 amended

(1) Regulation 3 is amended as follows:

(a)	by inserting before "In" the subregulation designation "(1)";
(b)	by inserting after the definition of "operating area" the following definition -

"prescribed licensee" means a licensee prescribed

under regulation 4.

(c) by deleting the definition of "SWIMCO".

(2) At the end of regulation 3 the following subregulation is

inserted -

IV

(2) The expressions "operating area", "operating

licence", "prescribed licensee" and "water services",
when used in a modification described in Schedule 1,

have the same respective meanings as they have in the

Act or these regulations.

6.            Regulation 4 replaced

Regulation 4 is repealed and the following regulation is inserted instead -

4.            Prescribed licensees, s. 45(1)

The licensees specified in the Table to this regulation
are prescribed for the purposes of Parts 1 and 5 of
Schedule 2 to the Act.

7.           Regulation 6 amended

(1) Regulation 6 is amended as follows:

(a)	by inserting before "The" the subregulation designation "(1)";
(b)	by inserting before "Schedule 2" -

Part lof ";

(c) by deleting "SWIMCO" and inserting instead -

a prescribed licensee ".

(2) At the end of regulation 6 the following subregulation is

inserted -

(2) The enactments specified in Part 2 of Schedule 2 do not

apply in relation to Preston Valley Irrigation

Co-operative Limited.

8. Regulation 7 amended
Regulation 7(1) is amended by deleting "SWIMCO" and
inserting instead -

a prescribed licensee ".

9.            Regulation 8 amended

Regulation 8(1) and (2) are amended by deleting "SWIMCO" and inserting instead -

a prescribed licensee ".

10.          Schedule 1 amended

Schedule 1 is amended in the second modification to section 70
of the Water Agencies (Powers) Act 1984 by deleting
"SWIMCO" and inserting instead -

a prescribed licensee ".

11.          Schedule 2 amended

Schedule 2 is amended as follows: 

(a) by inserting before the heading "Water Agencies (Powers) Act 1984" the following heading -

Part 1 ";

(b) by inserting at the end of the Schedule the following Part -
