Water Services Amendment Regulations 2020

Made by the Governor in Executive Council.

1.             Citation

These regulations are the Water Services Amendment
Regulations 2020.

2.             Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2 — on the day on which these

regulations are published in the Gazette;

(b) the rest of the regulations — on the day after that day.

3.             Regulations amended

These regulations amend the Water Services Regulations 2013.

4.             Regulation 3 amended

In regulation 3(1) insert in alphabetical order:

family violence has the meaning given in the
Restraining Orders Act 1997 section 5A;

5.             Regulation 7A inserted

After regulation 7 insert:

7A. Codes of practice: family violence
For the purposes of section 26(2) of the Act, matters
relating to customers who are directly or indirectly
affected by family violence are prescribed.

6.             Regulation 65 amended

(1) In regulation 65(4) delete “The” and insert:
Unless subregulation (5) applies, the

(5) The licensee must not make a record relating to a
customer available for inspection by a person under
subregulation (4), or give a copy of a particular record
relating to the customer to a person under
subregulation (4), if doing so would disclose
information that the customer has requested be kept
confidential because the customer believes that
disclosure of the information could increase the risk of
family violence to the customer or a person associated
with the customer.
(6) Subregulation (5) does not apply if the customer
consents to the information being disclosed to the
person.
