s1 4 s4 Water Resources (Rates and Charges) Amendment (No. 1) No. 277, 1995 ˙ Short title 1. This regulation may be cited as the Water Resources (Rates and Charges) Amendment Regulation (No. 1) 1995 . ˙ Regulation amended 2. This regulation amends the WaterResources(RatesandCharges)Regulation 1992 . ˙ Amendment of s 2 (Definitions) 3.(1) Section 2— insert— ‘ “consumer offtake” means water outlet works comprising a meter, valve and pipe fittings installed on a bulk water supply pipeline for conveying water to individual consumers. “rural residential purposes” of the use of water on land with an area not more than 10 ha that is in a rural residential zone (however described) under a planning scheme under the Local Government (Planning andEnvironment)Act1990 , includes agricultural and horticultural purposes.’. (2) Section 2, definition “QIDC business variable rate” — omit, insert — ‘ “QIDC business variable lending rate” means the variable interest rate Queensland Industry Development Corporation charges on amounts lent to business.’. ˙ Amendment of s 5 (Interest on outstanding debt) 4. Section 5, ‘11.5%’— omit, insert— ‘13%’.

Sections 17 and 18— omit, insert— ˙ ‘ Nominal allocation charges ‘ 17.(1) Before the chief executive grants a nominal allocation for land in an irrigation area or irrigation project, the owner of the land must pay to the chief executive the nominal allocation charge specified for the land in schedule 3. ‘ (2) Despite subsection (1), the chief executive may grant the nominal allocation if the owner of the land arranges for payment of the nominal allocation charge for the land by instalments on terms satisfactory to the chief executive. ‘ (3) The owner of the land is not required to pay the nominal allocation charge for the land if— (a) the owner acquires the land through an auction under the LandAct 1994 ; and (b) a nominal allocation is granted for the land before the land is offered for auction. ˙ ‘ Payment of a nominal allocation charge by instalments ‘ 18.(1) This section applies if an owner of land pays a nominal allocation charge by instalments. ‘ (2) The owner must— (a) pay interest on the unpaid part of the charge; and (b) comply with the agreed terms for payment of instalments. ‘ (3) Interest on the unpaid part of the charge— (a) accrues from the day the nominal allocation is granted; and (b) is payable at a rate that is 1.5% above the QIDC business variable lending rate applying on the day each instalment is payable.’.

Schedules 1 and 2— omit, insert— ‘ SCHEDULE 1 s6 No. 277, 1995 ‘ CHARGES—AREAS OTHER THAN MAREEBA–DIMBULAH sections 13 and 14 ˙ ‘ Awoonga–Callide pipeline project ‘ 1.(1) In this area, the water year ends on 30 June. ‘ (2) The prescribed percentage of the nominal allocation is 100%. ‘ (3) There is no minimum annual fixed amount. ‘ (4) The charge for the supply from a consumer offtake of each ML of water for stock or domestic purposes is $330.50. ˙ ‘ Barker–Barambah project ‘ 2.(1) In this area, the water year ends on 30 June. ‘ (2) The prescribed percentage of the nominal allocation is 75%. ‘ (3) The minimum annual fixed amount is $166.25. ‘ (4) The following charges apply for the supply of water from a regulated section of a watercourse— (a) $10.00 for each ML up to the announced allocation; (b) $25.00 for the first ML over the announced allocation; (c) $100.00 for each further ML over the announced allocation. ‘ (5) The charge for the supply of water by water harvesting is $2.50 for each ML up to 500 ML.
s6 7 s6 Water Resources (Rates and Charges) Amendment (No. 1) No. 277, 1995 ‘ (6) The following charges apply for the supply of water from the Redgate relift section— (a) $21.65 for each ML up to the announced allocation; (b) $25.00 for the first ML over the announced allocation; (c) $100.00 for each further ML over the announced allocation. ˙ ‘ Barns ground water area ‘ 3.(1) In this area, the water year ends on 30 June. ‘ (2) The prescribed percentage of the nominal allocation is 50%. ‘ (3) The minimum annual fixed amount is $84.70. ‘ (4) The following charges apply for the supply of water from the area— (a) $1.25 for each ML up to the announced allocation; (b) $19.75 for each further ML up to 20 ML over the announced allocation; (c) $38.35 for each further ML over the announced allocation. ˙ ‘ Bowen–Broken Rivers project ‘ 4.(1) In this area, the water year ends on 31 December. ‘ (2) The prescribed percentage of the nominal allocation is 75%. ‘ (3) The minimum annual fixed amount is $169.40. ‘ (4) The charge for each ML of water supplied from a regulated section of the Bowen River or Broken River is $11.75. ˙ ‘ Bowen ground water area ‘ 5.(1) In this area, the water year ends on 31 December. ‘ (2) The prescribed percentage of the nominal allocation is 75%. ‘ (3) The minimum annual fixed amount is $83.15. ‘ (4) The charge for each ML of water supplied is $3.90.
s6 8 s6 Water Resources (Rates and Charges) Amendment (No. 1) No. 277, 1995 ˙ ‘ Boyne River project ‘ 6.(1) In this area, the water year ends on 30 June. ‘ (2) The prescribed percentage of the nominal allocation is 75%. ‘ (3) The minimum annual fixed amount is $166.25. ‘ (4) The following charges apply for the supply of water from a regulated section of the Boyne River— (a) $10.55 for each ML up to the announced allocation; (b) $21.10 for each ML over the announced allocation; (c) by water harvesting—$2.55 for each ML up to 500 ML. ˙ ‘ Bundaberg irrigation area or project ‘ 7.(1) In this area, the water year ends on 30 June. ‘ (2) The prescribed percentage of the nominal allocation is 50%. ‘ (3) The minimum annual fixed amount is— (a) for water from a channel—$338.80; and (b) for surface water—$169.40; and (c) for ground water—$84.70. ‘ (4) The following charges apply for the supply of water from a channel or watercourse supplemented from a channel— (a) $37.05 for each ML up to the announced allocation; (b) $55.55 for each further ML up to 20 ML over the announced allocation; (c) $74.10 for each further ML over the announced allocation. ‘ (5) The following charges apply for the supply of water from a regulated section of a watercourse— (a) $11.80 for each ML up to the announced allocation; (b) $30.40 for each further ML up to 20 ML over the announced allocation;
s6 9 s6 Water Resources (Rates and Charges) Amendment (No. 1) No. 277, 1995 (c) $48.90 for each further ML over the announced allocation. ‘ (6) The following charges apply for the supply of water by water harvesting— (a) from a channel—$37.05 for each ML; (b) from a regulated section of a watercourse—$2.95 for each ML. ‘ (7) The following charges apply for the supply of water from ground water in the Bundaberg ground water area— (a) $4.80 for each ML up to the announced allocation; (b) $23.30 for each further ML up to 20 ML over the announced allocation; (c) $41.85 for each further ML over the announced allocation. ‘ (8) The following charges apply for the supply of water to on-farm storage— (a) from a channel—$74.10 for each ML; (b) from a regulated section of a watercourse—$23.60 for each ML. ˙ ‘ Burdekin River irrigation area or project ‘ 8.(1) In this area, the water year ends on 30 June. ‘ (2) The prescribed percentage of the nominal allocation is 75%. ‘ (3) The minimum annual fixed amount is— (a) for water from a channel—$338.80; and (b) for surface water—$169.40; and (c) for ground water—$84.70. ‘ (4) The following charges apply for the supply of each ML of water— (a) from a channel or regulated drain—$37.20; (b) from a diversion from unregulated drains—$9.30; (c) from a regulated section of the Burdekin River—$11.80; (d) from the Burdekin ground water area—$6.20;
s 6 10 s 6 Water Resources (Rates and Charges) Amendment (No. 1) No. 277, 1995 (e) from the Giru ground water area or a regulated section of the Haughton River— (i) for an allocation issued before 1 March 1995—$18.60; and (ii) for an allocation issued on or after 1 March 1995—$37.20; (f) from the Horseshoe Lagoon ground water area—none; (g) from Glady’s Lagoon— (i) for an amount taken up to natural yield—none; and (ii) for an amount from an additional allocation—$37.20. ˙ ‘ Callide Valley project ‘ 9.(1) In this area, the water year ends on 30 June. ‘ (2) The prescribed percentage of the nominal allocation is— (a) in the Callide Valley ground water area—75%; and (b) for the area not in the Callide Valley ground water area—100%. ‘ (3) The minimum annual fixed amount for ground water is $83.15. ‘ (4) The following charges apply for the supply of water from ground water in the Callide Valley ground water area or from surface water— (a) $7.85 for each ML up to the announced allocation; (b) $15.70 for each further ML up to 20 ML over the announced allocation; (c) $62.80 for each further ML up to 50 ML over the announced allocation; (d) $141.30 for each further ML over the announced allocation. ‘ (5) The following charges apply for the supply of water from ground water not in the Callide Valley ground water area— (a) $1.00 for each ML up to the announced allocation; (b) $15.70 for each further ML up to 20 ML over the announced allocation;
s 6 11 s 6 Water Resources (Rates and Charges) Amendment (No. 1) No. 277, 1995 (c) $62.80 for each further ML up to 50 ML over the announced allocation; (d) $141.30 for each further ML over the announced allocation. ˙ ‘Chinchilla Weir project ‘ 10.(1) In this area, the water year ends on 31 August. ‘ (2) The prescribed percentage of the nominal allocation is 75%. ‘ (3) The minimum annual fixed amount is $166.25. ‘ (4) The charge for the supply of water from a regulated section of the Condamine River is $11.60 for each ML. ‘ (5) The charge for the supply of water by water harvesting is $2.90 for each ML up to 500 ML. ˙ ‘ Condamine ground water area ‘ 11.(1) In this area, the water year ends on 30 June. ‘ (2) The prescribed percentage of the nominal allocation is 75%. ‘ (3) The minimum annual fixed amount is $84.70. ‘ (4) The following charges apply for the supply of water from the area— (a) if the total amount supplied in a water year is not more than 130% of the nominal allocation the charge is— (i) $1.65 for each ML up to the nominal allocation; and (ii) $6.55 for each further ML up to 10 ML over the nominal allocation; and (iii) $12.90 for each further ML up to 20 ML over the nominal allocation; and (iv) $23.20 for each further ML up to 40 ML over the nominal allocation; and (v) $52.65 for each further ML up to 60 ML over the nominal allocation; and
s 6 12 s 6 Water Resources (Rates and Charges) Amendment (No. 1) No. 277, 1995 (vi) $78.95 for each further ML over the nominal allocation; (b) if the total amount supplied in a water year is over 130% of the nominal allocation, the charge is the amount worked out under paragraph (a) plus $78.95 for each ML over 130% of nominal allocation. ˙ ‘ Cressbrook Creek project ‘ 12.(1) In this area, the water year ends on 30 June. ‘ (2) The minimum annual fixed amount is— (a) for surface water—$83.15; and (b) for ground water—$83.15. ‘ (3) The charge for the supply of water from the Cressbrook Creek ground water area or from surface water is $1.10 for each ML. ˙ ‘ Cunnamulla Weir project ‘ 13.(1) In this area, the water year ends on 31 August. ‘ (2) The prescribed percentage of the nominal allocation is 75%. ‘ (3) The minimum annual fixed amount is $169.40. ‘ (4) The following charges apply for the supply of water from this project— (a) $11.15 for each ML up to the announced allocation; (b) $22.30 for each further ML up to 125% of the announced allocation; (c) $33.45 for each further ML. ˙ ‘ Dawson Valley irrigation area or project ‘ 14.(1) In these areas, the water year ends on 30 September. ‘ (2) The prescribed percentage of the nominal allocation is 75%. ‘ (3) The minimum annual fixed amount is—
s 6 13 s 6 Water Resources (Rates and Charges) Amendment (No. 1) No. 277, 1995 (a) for water from a channel supply—$332.50; and (b) for surface water—$166.25. ‘ (4) The following charges apply for the supply of water from a channel— (a) $25.60 for each ML up to the announced allocation; (b) $51.20 for each further ML up to 125% of the announced allocation; (c) $76.80 for each further ML. ‘ (5) The following charges apply for the supply of water from the regulated section of the Dawson River downstream of Glebe Weir to the junction with Herbert Creek— (a) $10.70 for each ML up to the announced allocation; (b) $51.20 for each further ML up to 125% of the announced allocation; (c) $76.80 for each further ML. ‘ (6) The following charges apply for the supply of water from the Glebe Weir reservoir— (a) $3.70 for each ML up to the announced allocation; (b) $51.20 for each further ML up to 125% of the announced allocation; (c) $76.80 for each further ML. ‘ (7) The following charges apply for the supply of water by water harvesting— (a) from a channel—$25.60; (b) from a regulated section of the Dawson River and from the Glebe Weir reservoir—$2.70 for each ML up to 500 ML. ˙ ‘ Dumaresq River project ‘ 15.(1) In this area, the water year ends on 30 September. ‘ (2) The prescribed percentage of the nominal allocation is 75%.
s 6 14 s 6 Water Resources (Rates and Charges) Amendment (No. 1) No. 277, 1995 ‘ (3) The minimum annual fixed amount is— (a) for surface water—$166.25; and (b) for ground water—$83.15. ‘ (4) The following charges apply for the supply of water from a regulated section of a watercourse flowing from Glenlyon Dam— (a) $9.90 for each ML up to the announced allocation; (b) $99.00 for each ML over the announced allocation. ‘ (5) The charge for the supply of water from ground water in the Dumaresq ground water area is $1.55 for each ML. ‘ (6) The charge for the supply of water by water harvesting is $2.50 for each ML up to 500 ML. ˙ ‘ Emerald irrigation area or project ‘ 16.(1) In these areas, the water year ends on 30 June. ‘ (2) The prescribed percentage of the nominal allocation is 75%. ‘ (3) The minimum annual fixed amount is— (a) for water from a channel supply—$338.80; and (b) for surface water—$169.40. ‘ (4) The following charges apply for the supply of water from a channel— (a) $22.35 for each ML up to the announced allocation; (b) $44.70 for each further ML up to 125% of the announced allocation; (c) $67.05 for each further ML. ‘ (5) The following charges apply for the supply of water from Fairbairn Dam, or a regulated section of the Nogoa River or Mackenzie River to the junction with Springton Creek— (a) $10.90 for each ML up to the announced allocation; (b) $21.80 for each further ML up to 125% of the announced

s 6 25 s 6 Water Resources (Rates and Charges) Amendment (No. 1) No. 277, 1995 ˙ ‘ Warrill Valley project ‘ 34.(1) In this area, the water year ends on 30 June. ‘ (2) The prescribed percentage of the nominal allocation is 75%. ‘ (3) The minimum annual fixed amount is $166.25. ‘ (4) The following charges apply for the supply of water from a regulated section of Creek or Warrill Creek— (a) $10.00 for each ML up to the announced allocation; (b) $15.00 for each further ML up to 125% of the announced allocation; (c) $20.00 for each further ML up to 150% of the announced allocation; (d) $30.00 for each further ML. ‘ (5) The following charges apply for the supply of water from a regulated section of Black Gully, Bremer River, Kent’s Lagoon, Normanby Gully, West Branch, Warroolaba Creek and the Upper Warrill systems— (a) $11.35 for each ML up to the announced allocation; (b) $17.00 for each further ML up to 125% of the announced allocation; (c) $22.70 for each further ML up to 150% of the announced allocation; (d) $34.05 for each further ML. ‘ (6) The following charges apply for the supply of water by water harvesting— (a) for water from a regulated section of Reynolds Creek or Warrill Creek—$2.50 for each ML up to 500 ML; (b) for water from a regulated section of Black Gully, Bremer River, Kent’s Lagoon, Normanby Gully, West Branch, Warroolaba Creek and the Upper Warrill systems—$2.85 for each ML up to 500 ML.
s 6 26 s 6 Water Resources (Rates and Charges) Amendment (No. 1) No. 277, 1995 ‘ SCHEDULE 2 ‘ CHARGES—MAREEBA–DIMBULAH section 15 ˙ ‘ Mareeba-Dimbulah irrigation area or project ‘1.(1) In this area, the water year ends on 30 June. ‘ (2) The amount payable for water taken for an owner’s land is $372.25 plus a charge based on— (a) the nominal allocation of the owner’s land as worked out under subsection (3), and (b) the amount of water taken as worked out under subsection (4). ‘ (3) The charge for water supplied, based on the nominal allocation of the owner’s land, is as follows— (a) in a relift area—$14.70 for each ML; (b) from a channel supply— (i) $13.60 for each ML up to 100 ML; and (ii) $9.05 for each further ML up to 500 ML; and (iii) $7.90 for each further ML; (c) from a regulated section of— (i) Tinaroo Falls Dam or the Barron River—$6.80 for each ML; and (ii) Emerald Creek above AMTD 14.300—$2.95 for each ML; and (iii) another watercourse—$11.35 for each ML. ‘ (4) The charge for an amount of water taken is as follows— (a) for water taken up to the announced allocation from a channel in a relift area—$22.60 for each ML;
