Legislative history
1—Short title
These regulations may be cited as the Water Resources (Marne River and Saunders Creek—Prescribed Water Resources) Regulations 2003.
2—Commencement
These regulations come into operation on the day on which they are made.
Note—
As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in this regulation.
3—Interpretation
In these regulations, unless the contrary intention appears—
Marne River and Saunders Creek Area means the area comprising the Marne River Proposed Prescribed Water Resources Area and the Saunders Creek Proposed Prescribed Water Resources Area as delineated and shown on GRO plan No. 429/2002.
4—Declaration of surface water prescribed area
The Marne River and Saunders Creek Area is declared to be a surface water prescribed area.
5—Establishment and prescribed periods—surface water prescribed area
(1)The establishment period in relation to the surface water prescribed area declared by regulation 4 commenced on 6 May 1996 and ended at the commencement of the prescribed period (24 January 2002).
(2)The prescribed period in relation to the surface water prescribed area declared by regulation 4 commenced on 24 January 2002 and ends 3 years from the day on which these regulations come into operation.
6—Declaration of prescribed watercourses
All watercourses in the Marne River and Saunders Creek Area are declared to be prescribed watercourses.
7—Establishment and prescribed periods—watercourses
(1)The establishment period in relation to the prescribed watercourses declared by regulation 6 commenced on 6 May 1996 and ended at the commencement of the prescribed period (24 January 2002).
(2)The prescribed period in relation to the prescribed watercourses declared by regulation 6 commenced on 24 January 2002 and ends 3 years from the day on which these regulations come into operation.
8—Declaration of wells
Existing wells in the Marne River and Saunders Creek Area and wells drilled in that Area in the future are declared to be prescribed wells.
9—Establishment and prescribed periods—wells
(1)The establishment period in relation to the prescribed wells declared by regulation 8 commenced on 6 May 1996 and ended at the commencement of the prescribed period (24 January 2002).
(2)The prescribed period in relation to the prescribed wells declared by regulation 8 commenced on 24 January 2002 and ends 3 years from the day on which these regulations come into operation.

Revocation of regulations
The Water Resources (Marne River and Saunders Creek—Prescribed Water Resources) Regulations 2003 were revoked by Sch 1 of the Water Resources (Marne Saunders Prescribed Water Resources Area) Regulations 2005 on 7.4.2005.
