s1 2 s4 Water Resource (Burnett Basin) Amendment Plan No. 264, 2005 (No. 1) 2005 1 Short title This water resource plan may be cited as the Water Resource (Burnett Basin) Amendment Plan (No. 1) 2005 . 2 Water resource plan amended This water resource plan amends the Water Resource (Burnett Basin) Plan 2000. 3 Amendments changing ‘regulated’ to ‘supplemented’ (1) Subsection (2) applies to the following provisions (the stated provisions )— (a) sections 23(a), 24(1), 32(1)(a) and 34(2); (b) schedule 6, part 1, heading and items 1 and 2; (c) schedule 9, definition regulated water sharing index . (2) The stated provisions, ‘regulated’— omit, insert— ‘supplemented’. 4 Amendments changing ‘unregulated’ to ‘unsupplemented’ (1) Subsection (2) applies to the following provisions (the stated provisions )— (a) sections 6(d), 23(b), 24(2) and 26(2)(a); (b) schedule 6, part 2, heading and items 1, 2 and 3; (c) schedule 9, definitions 30% unregulated water sharing index , 50% unregulated water sharing index and 70% unregulated water sharing index . (2) The stated provisions, ‘unregulated’— omit, insert— ‘unsupplemented’.

s5 3 s5 Water Resource (Burnett Basin) Amendment Plan No. 264, 2005 (No. 1) 2005 5 Amendment of sch 2 (Water project areas) (1) Schedule 2, section 1(a)— omit, insert— ‘(a) the part of Barambah Creek from downstream of Stonelands gauging station (AMTD 85.0km) to AMTD 189.5km, including the impounded areas of all storages in the part of the creek; and’. (2) Schedule 2, section 2, ‘115.1km’— omit, insert— ‘110.5km’. (3) Schedule 2, section 3(a), ‘(AMTD 14.5km to AMTD 115km)’— omit, insert— ‘(AMTD 14.7km to AMTD 116.0km)’. (4) Schedule 2, section 3(b)— omit, insert— ‘(b) the part of the Burnett River between Ben Anderson Barrage and the impounded area of the Burnett River Dam, including the impounded areas of the barrage and Ned Churchward Weir (AMTD 25.9km to AMTD 162.8km); and’. (5) Schedule 2, section 4(a), ‘the confluence of Three Moon Creek and the Burnett River’— omit, insert— ‘Abercorn’. (6) Schedule 2, section 5(a)— omit, insert— ‘(a) the part of the Burnett River between the impounded area of the Burnett River Dam and John Goleby Weir, including the impounded areas of Claude Wharton Weir, Jones Weir, Kirar Weir and John Goleby Weir (AMTD 162.8km to AMTD 333.9km); and’.

(2) Schedule 7, entry for pump size 405— omit . (3) Schedule 7— insert— ‘450 55.0’. 7 Amendment of sch 9 (Dictionary) (1) Schedule 9, definitions regulated water and unregulated water — omit . (2) Schedule 9— insert— ‘ supplemented water means water supplied under an interim resource operations licence, resource operations licence or other authority to operate infrastructure. unsupplemented water means water that is not supplemented water.’. (3) Schedule 9, definition simulation period , ‘section 21(1)’— omit, insert— ‘section 15(1)’.
