s1 2 s4 Water Resource (Border Rivers) Amendment Plan No. 126, 2007 (No. 1) 2007 1 Short title This water resource plan may be cited as the Water Resource (Border Rivers) Amendment Plan (No. 1) 2007 . 2 Water resource plan amended This water resource plan amends the Water Resource (Border Rivers) Plan 2003. 3 Amendment of s 11 (Environmental flow objective (s 10(a))) (1) Section 11, from ‘61%’— omit, insert— ‘60.8% of the pre-development flow pattern using scenario BOR0609U.’. (2) Section 11— insert— ‘(2) In this section— scenario BOR0609U means the scenario of hydrological events— (a) simulated using the IQQM computer program; and (b) agreed to between the State and New South Wales for working out water sharing rules to meet the environmental flow objective.’. 4 Replacement of s 12 (Environmental flow objectives (s 10(b) to (e))) Section 12— omit, insert— ‘12 Environmental flow objectives (s 10(b) to (e)) ‘The environmental flow objectives are that at each node mentioned in schedule 2A, column 1, the extent to which a performance indicator mentioned in schedule 2A, column 2, for the node, expressed as a percentage of the same indicator
s5 3 s6 Water Resource (Border Rivers) Amendment Plan No. 126, 2007 (No. 1) 2007 for the pre-development flow pattern, is less than the lower percentage, or more than the higher percentage, of the range stated in schedule 2A, column 3, for the indicator be minimised.’. 5 Amendment of s 13 (Environmental flow objectives (assessing impact of decisions)) Section 13(b)— omit, insert— ‘(b) at each node mentioned in schedule 2A, column 1, a performance indicator, mentioned in schedule 2A, column 2, for the node be— (i) not less than the lesser of the following— (A) the lower percentage of the range stated in schedule 2A, column 3, for the indicator; (B) the indicator immediately before the decision is made; and (ii) not more than the greater of the following— (A) the higher percentage of the range stated in schedule 2A, column 3, for the indicator; (B) the indicator immediately before the decision is made.’. 6 Amendment of s 15 (Water allocation security objectives) (1) Section 15(a)— omit, insert— ‘(a) the annual volume probability for a water allocation group be at least— (i) for taking unsupplemented water—the annual volume probability for the group immediately before the decision is made; and (ii) for taking supplemented water in the Macintyre Brook water supply scheme—the annual volume
