Water Rates (Amendment) Act 1989

An Act to amend the Water Rates Act 1959

The Legislative Assembly for the Australian Capital Territory enacts as follows:

Short title

1.  This Act may be cited as the Water Rates (Amendment) Act 1989.

Principal Act

2.  In this Act, “Principal Act” means the Water Rates Act 1959.1

Recovery of rates

3.  Section 26 of the Principal Act is amended by adding at the end the following subsections:

“(2)  Notwithstanding subsection (1), where, on 16 October 1989, an amount for rates payable under this Act in respect of a rating year that ended on or before 30 June 1988 remains unpaid—

(a)that amount is a debt due and payable to the Territory; and

(b)on and after that 16 October the person liable to pay the rates is liable to pay to the Territory, in addition to that amount, interest calculated in accordance with subsection (3) at such rate as is determined by the Minister by instrument.

“(3)  The interest payable shall be calculated—

(a)on the aggregate of—

(i)the amount of unpaid rates; and

(ii)the amount of accumulated unpaid interest; and

(b)in respect of each month after 15 October 1989 during any part of which the rates or any accumulated interest remains unpaid.

“(4)  Payments of rates payable under this Act that were made to the Authority in the period commencing on 1 July 1988 and ending on the commencement of this subsection in respect of a rating year that ended on or before 30 June 1988 shall, for the purposes of this Act, be deemed to have been made to the Territory.

“(5) A determination under subsection (2) is a disallowable instrument for the purposes of section 10 of the Subordinate Laws Act 1989.”.
