s1 2 s2 Water (Mary River Water Supply Scheme—Emergency) Notice 2003 No. 9, 2003 1 Short title This notice may be cited as the Water (Mary River Water Supply Scheme—Emergency) Notice 2003 . 1 2 Emergency declaration (prohibition)—Act s 22 (1) Under section 22(2)(c) of the Act, irrigation from the following is prohibited— (a) the Mary River between AMTD 85 km (upstream storage limit of Mary River barrage) and the Mary River barrage; (b) the storage impoundment of Teddington Weir on Tinana Creek; (c) the storage impoundment of the Tinana Creek barrage; (d) SunWater’s water infrastructure, including channels and pipelines, for taking water from the Mary River barrage and the Tinana Creek barrage; (e) the Mary River between AMTD 180 km (Kidd’s Bridge, Gympie) and AMTD 85 km when the level of water in a waterhole in that part of the river is at or below 1 metre below the downstream control of the water level in the waterhole; (f) Yabba Creek from Borumba Dam to the creek’s junction with the Mary River; (g) the Mary River between its junction with Yabba Creek and AMTD 180 km; (h) Obi Obi Creek below Baroon Pocket Dam; (i) the Mary River between its junction with Obi Obi Creek and its junction with Yabba Creek. (2) However, subsection (1)(f) to (i) does not apply to the extent SunWater has approved the taking of credit water under the credit water operating rules. 1 Section 22(4) of the Act— The notice remains in force until whichever of the following first happens— (a) the commencement of a regulation dealing with the matters mentioned; (b) the end of 21 days after the day the notice is published.
s3 3 s3 Water (Mary River Water Supply Scheme—Emergency) Notice 2003 No. 9, 2003 (3) Also subsection (1) does not apply to the extent SunWater makes provision for supply of water, to a maximum of 0.1 ML a week, in a case where— (a) in SunWater’s opinion, a water entitlement holder’s need for irrigation is critical; and (b) the holder has not taken water up to or in excess of the holder’s announced entitlemement. 3 Emergency declaration (restriction)—Act s 22 Under section 22(2)(a) of the Act, an owner of land adjoining a watercourse mentioned in section 2 who takes water from the watercourse for either of the following purposes must not take the water at more than the rate of 0.025 ML a week— (a) domestic purposes; (b) watering stock of a number that would normally be depastured on the land.
