Water Management (Safety of Dams) Amendment Regulations 2006

1Short titleThese regulations may be cited as the Water Management (Safety of Dams) Amendment Regulations 2006 . 2CommencementThese regulations take effect on the day on which their making is notified in the Gazette. 3Principal RegulationsIn these regulations, the Water Management (Safety of Dams) Regulations 2003 are referred to as the Principal Regulations. 4Regulation 7 amended (Required competency standards) Regulation 7 of the Principal Regulations is amended as follows: (a) by omitting item 5 from the table in subregulation (2)(d) and substituting the following:

(d) by omitting subregulation (4) and substituting the following subregulation: (4)  Subject to regulation 8 , where an activity listed in Column 1 of the following table is required to be undertaken in respect of a dam which is of a hazard category specified in the table and which is more than 25 metres high, that activity is to be undertaken by – (a) a person or persons having the level of competence specified in the table in respect of that activity; or (b) an expert team, if so specified.

5Regulation 13 amended (Fees, allowances and compensation) Regulation 13 of the Principal Regulations is amended by omitting subregulation (1) and substituting the following subregulation: (1)  The fee payable to the Crown by the owner of a dam or proposed dam for assessing a design, construction, maintenance, surveillance or decommissioning report is 115 fee units, plus 77 fee units for each hour or part of an hour spent processing the report, excluding the first hour.

EXPLANATORY NOTE

(This note is not part of the regulation) These regulations amend the

(a) in respect of the competency standards required of people undertaking certain activities specified in those regulations to ensure consistency with the relevant ANCOLD guidelines; and (b) by increasing the fee payable for the assessment of certain reports.
