Water Management (General) Amendment Regulation 2008

Water Management Act 2000

Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Water Management Act 2000.

Explanatory note
The object of this Regulation is to amend the Water Management (General) Regulation 2004 so as to make it clear that water allocations may be carried over from year to year in accordance with any relevant water management plan.

This Regulation is made under the Water Management Act 2000, including section 400 (the general power to make regulations).

1      Name of Regulation

This Regulation is the Water Management (General) Amendment
Regulation 2008.

2 Amendment of Water Management (General) Regulation 2004

The Water Management (General) Regulation 2004 is amended as set out in Schedule 1.

(Clause 2)

Clause 16 Water allocation accounts

Insert after clause 16 (2):

(3)

Water allocations that arise during one accounting year may be carried over to the following accounting year, but only to the extent to which the relevant water management plan so provides.

(4) Subclause (3) is not limited or otherwise affected by any order in
force under section 60 (2) of the Act.

(5)

For the purposes of subclause (3), accounting year means the period of 12 months commencing on 1 July of any year and ending on 30 June of the following year.
