Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Water Management Act 2000.

Explanatory note
The Water Management Act 2000 empowers a private irrigation board (PIB) to take over an existing water supply work on a site within its private irrigation district (PID), subject to various requirements including the Minister’s and the Governor’s authorisation. If the take over is so authorised, the control and management of the work vests in the PIB on and from the vesting date specified in a notice of the proposed take over served by the PIB on the landholder of the land on which the work is situated.
The object of this Regulation is to exempt, until 30 June 2014, Lower Gingham PID No 1 Board (being the PIB for the Lower Gingham Private Irrigation District No 1) from the requirements that it must not serve such a notice after the expiration of 12 months after the constitution of its PID or on any person in respect of a work that belongs to, or is under the control or management of, a public authority.

This Regulation is made under the Water Management Act 2000, including section 400 (2), which empowers the making of a regulation exempting any person, matter or thing from the operation of the Act or any specified provision of the Act.

1      Name of Regulation

This Regulation is the Water Management (General) Amendment
(Lower Gingham PID No 1 Board) Regulation 2012.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

Clause 226A

Insert after clause 226:

226A

Exemptions relating to taking over works—Lower Gingham
PID No 1 Board

(1)	The private irrigation board Lower Gingham PID No 1 Board is exempt from section 159 (3) and (4) of the Act until the end of 30 June 2014.
(2)	In this clause: Lower Gingham PID No 1 Board means the board of management for the Lower Gingham Private Irrigation District No 1, constituted by a proclamation published in Gazette No 57 of 1 June 2012 at pages 2270–2272.
