Water Management (General) Amendment

(Licences) Regulation 2017

His Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Water Management Act 2000.

Explanatory note
The objects of this Regulation are:

(a) to create a new category of water access licence (the Penrith Lakes Scheme (initial fill of the lakes
that form part of the Scheme) access licence), and to declare that type of water access licence to be
a specific purpose access licence, for the purposes of the Water Management Act 2000, and

(b)

to provide that an application may be made under the Act for that type of specific purpose access licence and a major utility (Barnard) access licence.

This Regulation is made under the Water Management Act 2000, including sections 57 (1) (l), 61 (1) (a) and
400 (the general regulation-making power) and paragraph (e) of the definition of specific purpose access
licence in the Dictionary to the Act.

1      Name of Regulation

This Regulation is the Water Management (General) Amendment (Licences)
Regulation 2017.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Water Management (General) Regulation 2011

(1) Clause 4 Categories of access licence

Insert after clause 4 (1) (q):

(r)

Penrith Lakes Scheme (initial fill of the lakes that form part of the Scheme) access licence.

(2) Clause 5 Specific purpose access licences
Insert after clause 5 (1) (e):

(f)

Penrith Lakes Scheme (initial fill of the lakes that form part of the Scheme) access licence.

(3) Clause 10 Applications for specific purpose access licences
Insert after clause 10 (f):
(g) a major utility (Barnard) access licence,
(h) a Penrith Lakes Scheme (initial fill of the lakes that form part of the Scheme) access licence.
