Explanatory note
The object of this Regulation is to prescribe a major utility (Barnard) access licence as a new category of access licence and to provide that the access licence is a specific purpose access licence. An application for this category of licence is to be permitted under the proposed Water Sharing Plan for the Hunter Regulated River Water Source 2016. This is to allow AGL Macquarie Pty Ltd to extract water from the Glenbawn Dam, being water that it has pumped into that Dam from the Barnard River (which is a water source that is not covered by that plan).
This Regulation also exempts persons who take water for the purposes of watering plantations of sugar cane from the requirement to hold an access licence if the water is taken from a sunken artificial channel constructed to drain water from the land on which the cane is grown and the channel is located in an area to which the Water Sharing Plan for the Clarence River Unregulated and Alluvial Water Sources 2016 or the Water Sharing Plan for the Brunswick Unregulated and Alluvial Water Sources 2016 applies.

This Regulation is made under the Water Management Act 2000, including sections 57 (1) (l) and 400 (the general regulation-making power) and the definition of specific purpose access licence in the Dictionary to that Act.

1      Name of Regulation

This Regulation is the Water Management (General) Amendment (Access Licence)
Regulation 2016.

2      Commencement

This Regulation commences on 1 July 2016 and is required to be published on the
NSW legislation website.

Insert after clause 4 (1) (p):

(q) major utility (Barnard) access licence.

Insert after clause 5 (1) (d):
(e) major utility (Barnard) access licence.
(3) Schedule 5 Exemptions
Insert “the Water Sharing Plan for the Clarence River Unregulated and Alluvial Water Sources 2016, the Water Sharing Plan for the Brunswick Unregulated and Alluvial Water Sources 2016,” after “which” in clause 13 (e).
