THOMAS FREDERICK BATHURST, Lieutenant-Governor I, the Honourable Thomas Frederick Bathurst, Lieutenant-Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of sections 55A and 88A of the Water Management Act 2000, make the following Proclamation.

1      Name of Proclamation

This Proclamation is the Water Management (Application of Act to NSW Border Rivers Unregulated and Alluvial Water Sources) Proclamation 2012.

2      Commencement

This Proclamation commences on 1 June 2012 and is required to be published on the NSW legislation website.

3 Application of Parts 2 and 3 of Chapter 3 of Water Management Act 2000 to certain water sources, access licences and approvals

(1) It is declared that Part 2 of Chapter 3 of the Act applies to each water source to which the prescribed water sharing plan applies in relation to all categories and subcategories of access licence for any such water source other than floodplain harvesting access licences.
(2) It is declared that Part 3 of Chapter 3 of the Act applies to each water source to which the prescribed water sharing plan applies in relation to all approvals for any such water source other than drainage work approvals, flood work approvals and aquifer interference approvals.
(3) In this clause:
prescribed water sharing plan means the Water Sharing Plan for the
NSW Border Rivers Unregulated and Alluvial Water Sources 2012.
the Act means the Water Management Act 2000.
