THOMAS FREDERICK BATHURST, Lieutenant-Governor I, the Honourable Thomas Frederick Bathurst, Lieutenant-Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of sections 55A and 88A of the Water Management Act 2000, make the following Proclamation.

Water Management (Application of Act to Certain Water

Sources) Proclamation (No 2) 2012

under the

Water Management Act 2000

1      Name of Proclamation

This Proclamation is the Water Management (Application of Act to
Certain Water Sources) Proclamation (No 2) 2012.

2      Commencement

This Proclamation commences on 4 October 2012 and is required to be published on the NSW legislation website.

3 Application of Parts 2 and 3 of Chapter 3 of Water Management Act 2000 to certain water sources, access licences and approvals

(1) 

It is declared that Part 2 of Chapter 3 of the Act applies to the prescribed water source, and to each water source to which a prescribed water sharing plan applies, in relation to all categories and subcategories of access licence for any such water source other than floodplain harvesting access licences.

(2) 

It is declared that Part 3 of Chapter 3 of the Act applies to the prescribed water source, and to each water source to which a prescribed water sharing plan applies, in relation to all approvals for any such water source other than drainage work approvals, flood work approvals and aquifer interference approvals.

(3)  In this clause:
prescribed water sharing plan means each of the following plans:

(a)

the Water Sharing Plan for the Barwon-Darling Unregulated and Alluvial Water Sources 2012,

(b)

the Water Sharing Plan for the Belubula Regulated River Water Source 2012,

(c)

the Water Sharing Plan for the Macquarie Bogan Unregulated and Alluvial Water Sources 2012,

(d)

the Water Sharing Plan for the Murrumbidgee Unregulated and Alluvial Water Sources 2012,

(e) the Water Sharing Plan for the Namoi Unregulated and Alluvial Water Sources 2012.

prescribed water source means the part of the Murrumbidgee Regulated River Water Source referred to in clause 4 (3) (b) of the Water Sharing Plan for the Murrumbidgee Regulated River Water Source 2003 (as inserted by the Water Sharing Plan for the Murrumbidgee Regulated River Water Source Amendment Order 2012), excluding the water referred to in clause 4 (4) of that Plan (as inserted by that Order).

the Act means the Water Management Act 2000.
