Proclamation 2010

under the

Water Management Act 2000

MARIE BASHIR, Governor I, Professor Marie Bashir AC, CVO, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of sections 55A and 88A of the Water Management Act 2000, make the following Proclamation.

Clause 1 Proclamation 2010

Water Management (Application of Act to Certain Water

Sources) Proclamation 2010

under the

Water Management Act 2000

1      Name of Proclamation

This Proclamation is the Water Management (Application of Act to
Certain Water Sources) Proclamation 2010.

2      Commencement

This Proclamation commences on 17 December 2010 and is required to be published on the NSW legislation website.

3 Application of Parts 2 and 3 of Chapter 3 of Water Management Act 2000 to certain water sources, access licences and approvals

(1) 

It is declared that Part 2 of Chapter 3 of the Act applies to each water source to which a prescribed water sharing plan applies in relation to all categories and subcategories of access licence for any such water source other than floodplain harvesting access licences.

(2) 

It is declared that Part 3 of Chapter 3 of the Act applies to each water source to which a prescribed water sharing plan applies in relation to all approvals for any such water source other than drainage work approvals, flood work approvals and aquifer interference approvals.

(3)  In this clause:
prescribed water sharing plan means each of the following plans:

(a)

the Water Sharing Plan for the Murrah-Wallaga Area Unregulated and Alluvial Water Sources 2010,

(b)

the Water Sharing Plan for the Richmond River Area Unregulated, Regulated and Alluvial Water Sources 2010,

(c)

the Water Sharing Plan for the Towamba River Unregulated and Alluvial Water Sources 2010,

(d)

the Water Sharing Plan for the Tweed River Area Unregulated and Alluvial Water Sources 2010.

the Act means the Water Management Act 2000.
