WATER LEGISLATION AMENDMENT ACT 1997 No 128—

PROCLAMATION

(L.S.) GORDON SAMUELS, Governor.

I, the Honourable Gordon Samuels AC, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 of the Water Legislation Amendment Act 1997, do, by this my Proclamation, appoint 6 November 1998* as the day on which the following provisions of that Act commence:

(a) Schedule 1 [21],

(b)

so much of Schedule 1 [23] as inserts clause 11 (2) and (3) into Schedule 2 to the Water Act 1912,

(c)

so much of Schedule 1 [24] as inserts Schedule 3 into the Water Act 1912 (other than the paragraph relating to Sydney Water Corporation Limited),

(d) Schedule 2.1, 2.2 and 2.6.

The proclamation appointed 6.11.1998 as the date of commencement. Pursuant to s 23

(5) of the Interpretation Act 1987, the proclamation does not fail merely because it was not published in the Gazette until after the day appointed in the proclamation, but s 23 (5) provides, in that event, for the Act to commence on the day on which the proclamation was published in the Gazette.

Water Legislation Amendment Act 1997 No 128-Proclamation

EXPLANATORY NOTE

The object of this Proclamation is to commence certain uncommenced provisions of

the Water Legislation Amendment Act 1997 that:

(a) insert Part 9 (Licensing of water management authorities) into the Water Act

1912, and

(b) include Hunter Water Corporation Limited as a water management authority under that Act, and
(c) contain' consequential amendments to that Act and other Acts.
