Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Water Industry Competition Act 2006.

Explanatory note
The Water Industry Competition (General) Regulation 2008 exempts water or sewerage infrastructure that was being constructed or operated before that Regulation commenced, from the requirement for a licence under the Water Industry Competition Act 2006. The exemption operates until 8 August 2009. The object of this Regulation is to extend the operation of the exemption until 8 August 2010.

This Regulation is made under the Water Industry Competition Act 2006, including section 101 (the general regulation-making power) and clause 1 of Schedule 4 (the power to make regulations of a savings or transitional nature).

1      Name of Regulation

This Regulation is the Water Industry Competition (General)
Amendment (Extension of Transitional Exemption) Regulation 2009.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Water Industry Competition (General) Regulation 2008

Clause 33 Exemption from licensing requirements: transitional provision

Omit “8 August 2009” from clause 33 (2) (a).
Insert instead “8 August 2010”.
