Water Industry Act 1994

Water Industry (Amendment) Regulations 1998

The Governor in Council makes the following Regulations:

1. Objective

The objective of these Regulations is to amend the Regulations are consistent with amendments made to the Water Industry Act 1994 and to make other amendments.

2. Authorising provisions

These Regulations are made under sections 50, 51,
52, 179, 183 and 184 of the Water Industry Act

1994.

3. Commencement

These Regulations come into operation on
1 December 1998.

4. Principal Regulations

In these Regulations, the Water Industry
Regulations 19951 are called the Principal

Regulations.

5. Amendment of regulation 101

In regulation 101 of the Principal Regulations—

(a) paragraphs (a) and (f) are revoked;

(b) in paragraph (g), omit "fees,".

6. Empowering provision

In regulation 102 of the Principal Regulations, for

"183" substitute "179".

7. Definitions

In regulation 104 of the Principal Regulations—

(a)

"most recent water rate", "most recent
sewerage rate", "plumber", "relevant period",
"sewerage rate remission entitlement",
"unused sewerage rate remission
entitlement", "unused water rate remission

the definitions of "eligible beneficiary", entitlement" are revoked;

(b)

after the definition of "licensee" insert— ' "licensed plumber" in relation to a

particular class of work of water
supply, sanitary drainage or sewerage,
means a person who is licensed to carry
out that class of work under Part 12A of

the Building Act 1993.'.

8. Revocation of Part 2

Part 2 of the Principal Regulations is revoked.

9. Part 3—Works of Water Supply and Sewerage

For the heading to Part 3 of the Principal
Regulations substitute "PART 3—WORKS OF

WATER SUPPLY AND SEWERAGE".

10. Division 3—Plans for works of sewerage

For the heading to Division 3 of Part 3 of the
Principal Regulations substitute "Division 3—

Plans for Works of Sewerage".

11. Revocation of regulations

Regulations 301, 303–312, 321, 322, 324, 325 and
330 and Subdivisions 3 and 4 of Division 5 of
Part 3 and Division 8 of Part 3 of the Principal

Regulations are revoked.

12. New regulation 313 substituted

For regulation 313 of the Principal Regulations substitute—

"313. Plan of sanitary drains

The relevant licensee may require the licensed plumber responsible for sanitary drainage work to lodge a plan of the work at a scale of 1:500 with the licensee.".

13. Amendment of regulation 315

In regulation 315 of the Principal Regulations, for

"plumber" substitute "licensed plumber".

14. Amendment of regulation 316

In regulation 316(2)(a) of the Principal
Regulations, for "the Victoria Water Supply and
Sewerage Plumbing Regulations 1994" substitute
"Australian Standard AS 3565.1–1998 Meters for
cold potable water—Volumetric chamber and
turbine meters".

15. Amendment of regulation 318

In regulation 318(3) of the Principal Regulations,
for "or application referred to in regulation
303(1)" substitute "under section 63(2) of the

Act".

16. Amendment of regulation 326

In regulation 326 of the Principal Regulations—

(a) for "plumber" substitute "licensed
plumber";

(b) in paragraph (b) omit "inspected and".

17. Amendment of regulation 401

In regulation 401(1) of the Principal

Regulations—

(a) for paragraph (a) substitute— "(a) any matter discharged from premises as

a result of trade, industrial, commercial, medical, dental, veterinary, agricultural, horticultural or scientific research or

experimental activities; or";

(b)

in paragraph (d)(i), for "on trade premises" substitute "installed on premises where any activity referred to in paragraph (a) occurs";

(c)

in paragraph (d)(iv), for "trade premises" substitute "premises where any activity referred to in paragraph (a) occurs";

(d) paragraph (e) is revoked.

18. Amendment of regulation 403

For regulation 403(3) of the Principal Regulations
substitute—

"(3) If the licensee considers that the occupier has

not complied with any condition in a notice
under sub-regulation (1)—

(a) by the date specified in the notice; or

(b)

at any time during the period of 90 days from that date—

the licensee may serve written notice of
termination of the trade waste agreement on
the occupier and the agreement
automatically terminates at midnight on the
day on which the notice of termination is

served.".

19. Substitution of Part 7

For Part 7 of the Principal Regulations substitute—

"PART 7—PROCEEDINGS

701.  Prescribed person for the purposes of taking proceedings

For the purposes of section 179(1)(b) of the

Act, a prescribed person is a person appointed by the Environment Protection Authority to take proceedings for an offence against a provision of the Act or regulations.".

20. Revocation of the Schedule

The Schedule to the Principal Regulations is revoked.
