I, Rear Admiral PETER ROSS SINCEAIR, Governor of the State of New
South Wales, with the advice of the Executive Council, and in pursuance of section 2 of the Water Board (Amendment) Act 1991, do, by this my Proclamation, appoint 14 February 1992 as the day on which that Act commences.

EXPLANATORY NOTE TO EXECUTIVE COUNCIL MINUTE—
WATER BOARD (AMENDMENT) ACT 1990
The Water Board Act in its current form does not beyond doubt provide for or
allow the Board to enter into arrangements with the Private Sector in carrying out
the Board’s Objectives with Build/Own/Operate projects. The new legislation will
provide for the following:
(1) give the Board the express function and ability to enter into long term contractual arrangements with the private sector to execute Build/Own/Operate projects for the purpose of carrying out the Board’s objectives;

(2) expressly enable the Board to lease land to the private sector for long term
contractual arrangements;
(3) ensure that when the Board contracts an aspect of its functions through a private sector infrastructure project, the private sector is not prevented from
taking advantage of various taxation deductions.
