An Act to Amend" The Water Authorities Acts, T; ' ! o~ : ; ER IAuTHORITIES 1891 to 1931," in certain particulars. ACTS AMENDMENT [ASSENTED' TO 2ND DECEMBER, 1937.J ACT OF 1937. B E it enacted by the King's Most Excellent Majesty, by and with the advice and consenlt of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title 1. This Act may be cited as " The Water Authorities and . Acts Amendment Act of 1937," and shall be read as one constructIOn. with *" The Water Authorities Acts, 1891 to 1931," herein referred to as the Principal Act. Collective title. New s. 4B. The Principal Act and this Act may collectively be referred to as "The Water Authorities Acts, 1891 to 1937." Amendment of the Principal Act. 2. Water Authorities Acts Amendment Act. the powers, rights, and privileges as are prescribed in *" The Water Authorities Acts, 1891 to 1937," and to the intent that the provisions of subsection eight of section twenty-one of t" The Local Government Act of 1936 " may be utilised by the Local Authority in respect of its water rates and/or charges in addition to or in substitution for any like powers and authorities whether by making by-laws or otherwise under *" The Water Authorities Acts, 1891 to 1937," and to the intent that by-laws of a Local Authority may be made accordingly under t" The Local Government Act of 1936 " or *" The Water Authorities Acts, 1891 to 1937," or in part under t" The Local Government Act of 1936," and in part under *" The Water Authorities Acts, 1891 to 1937," and the provisions of section thirty- . one of t" The Local Government Act of 1936" and in particular the provisions of subsection twenty-seven of the said section thirty-one shall apply and extend accordingly to any such by-law. Moreover the undertaking of any such Water Authority shall be and be deemed to be an undertaking under and within the meaning of t" The Local Government Act of 1936" of the Local Authority concerned. Moreover for the purpose of adjusting its financial obligations and matters pertaining thereto, the financial year of the Local Authority as a Water Authority shall be the period of time from and including the first day of July in one calendar year to and including the thirtieth day of June in the next following calendar year. Sections twenty-three, twenty-four, twenty-five, twenty-six, twenty-seven, twenty-eight, twenty-nine, thirty, and thirty-one of t" The Local Government Act of 1936" shall so far as the same may be applicable apply and extend to any such Local Authority concerned. . Where any such Local Authority has at the . commencement of t" The Water Authorities Acts Amend- ment Act of 1937" an existing overdraft in respect of the water undertaking, the Local Authority shall extinguish the overdraft by one of the following methods, namely:- (a) By a fixed debenture loan having a currency of not more than fifteen years; or * 55 Vie.. (b) By making equal annual provisions in the budget of the Local Authority for a period not exceeding fifteen years for such water undertaking overdraft. No authority other than the issue of an Order in Council under section twenty-eight of *" The Local Government Act of 1936" shall be necessary where the Local Authority by resolution decides to extinguish the overdraft by way of a loan as hereinbefore provided, but the Local Authority shall not be required to observe the provisions of the said section." Validation. 3. All acts, matters, and things done or executed by a Local Authority prior to the passing of this Act which if done subsequent to the passing of this Act would be valid and lawful are approved, ratified, validated, and confirmed. Moreover all by-laws of a Local Authority made, whether under *" The Local Government Act of 1936 " and/or t" The Water Authorities Acts, 1891 to 1931," or under or in pursuance of both such Acts, are approved, ratified, validated,' and confirmed. The Governor in Council may from time to time make all such Orders in Council as he shall deem necessary or expedient to give full effect to the objects and purposes of this Act, and the provisions of *" The Local Government Act of 1936 " relating to the publication in the Gazette and to the effect of the publication in the Gazette of Orders in Council made under such last mentioned Act shall apply and extend to every Order in Council made or purporting to be made under this Act. * 1 Geo.
