Name of regulation
This regulation is the Water and Sewerage Amendment Regulation 2005 (No 2).
Commencement
This regulation commences on the day after its notification day.
NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).
Legislation amended
This regulation amends the Water and Sewerage Regulation 2001.
New section 16E (6) to (9)
insert
(6)Subsection (1) (b) does not apply to domestic water supply plumbing work (whether carried out before or after the commencement of this subsection) if—
(a)the tap is fitted with another device (a secondary device) that reduces the flow capacity of the tap for a kitchen or laundry sink or any other basin; or
(b)a compatible secondary device for the tap is not reasonably available in the ACT.
Example of secondary device
a valve in addition to the valve forming part of the tap
(7)For this section, a secondary device is not compatible if use of the device with a tap would void the tap manufacturer’s warranty.
(8)Subsection (7) does not limit when a secondary device is not compatible.
(9)Subsections (6), (7), (8) and this subsection expire on 1 July 2006.
